Federal Social Security benefits are not denied as part of the judges sentencing. It is a non sequitur.

I would be concerned about an employer who would say such a thing. Are they not matching and reporting benefits deducted before the employee was dismissed? Let's hope it was just the ramblings of an employee who doesn't know better.

I have the feeling that there was some miscommunication when retelling the story through so many people.

What the employer would have warned her about, is that since it is a rule that she had had explained to her, and if she blatantly disobeyed it, she would most likely not be able to collect UNEMPLOYMENT BENEFITS.

Now that makes sense right?

Fired for cause only means the employer will not be charged back when and if she receives the benefits. This keeps the employers rate from increasing. The employee is still eligible for benefits when other criteria is met. Such as the minimum number of quarters worked.

This girl is a friend of my friends daughter. My friends daughter did lose her job (already found another one) and will be fined and have to go to court. I don't know the other girl (that works at the convenience store)..she is a good friend of my friends daughter. I knew it didn't sound right and I'm thinking it's probably a tactic used by her employer.

Sounds like the friend who works at the store doesn't have a clue. Maybe HER employer at the store told her this, but since she has nothing to do with the restaurant that fired the other girl ???

I think the 2 girls were just discussing the importance of "carding" everyone...regardless of how old they look! PaPa with the walker may LOOK over 21..but card him anyway!

Actually my friends daughter has been cursed because she asked for ID...and it was pretty obvious the person was over 21 years old.

Take them to the Social Security office for a briefing. Make sure they took out the Social Security out of the paycheck if required by law. If not, put in a complaint against the ownere.
Why would they find the employee and make her go to court, curious, as here it is the bar owner that gets hit also. He/she should be aware of the apparent set up, and also curious, why do they have to card everyone they serve, and how do they remember who they did or not. Sounds like the bar owners are not the greatest employers. I would suggest they talk to the law enforcement people for additional information and training suggestions.

Apparently,they're not suppose to use their own judgment about the age of the customer. My friends DD said the woman she didn't card looked to be 30yrs. old or older...she was under 21! The restaurant will ALSO be fined (which explains why friends daughter lost her job). No doubt about it..it was a setup. The ABC (Alabama Beverage Control) people came in and picked the most crowded/busiest area to sit in. My friends daughter was really busy..then there was a party came in and also sat in her area. She was really really busy..and made a mistake! From what I understand..the ABC guy went to the car and came back with a camera AND a fingerprint kit and they took her picture and fingerprinted her!

If you have questions you need to read what the law is in YOUR state. It is extremely unlikely that you are going to find specifics about Alabama on a discussion board inhabited by Texans, Canadians, Wisconsinites, New Yorkers, and Australians speaking off the cuff.

One thing is for sure, and that is that Muni Court cannot control what the Federal Social Security Office does.

Now then, Social Security does have rules about paying benefits to those who are incarcerated for crimes they commit, while they are incarcerated. They don't send SS checks to prisoners in jail. Once out, even felons can receive SS checks if they are routinely eligible.

Social Security benefits are not paid for the months you have been sentenced to a jail, prison or correctional facility or confined to certain public institutions for committing a crime. And, no benefits can be paid for any month in which you violate a condition of your probation or parole.

Although you cannot receive monthly Social Security benefit payments while you are confined, your spouse or children can be paid benefits on your record if they are eligible.

I don't know the all the laws in AL but I cannot see a first time offender, young girl working retail, doing any actual jail time over this. Then again I know that Alabama has dry counties and maybe judges have a "get tough" policy regarding the enforcement of alcohol laws and dole out harsh punishments for disobeying the alcohol laws. In my state there would be a HUGE monetary fine for something like this and it could be charged as a felony or a misdemeanor depending on the circumstances surrounding the case. There could possibly be jail time depending on the circumstances of the case. There may be loss of license for premise owner and also for the employee. For an employee to lose their license would be devastating as most employers won't hire someone without one even though they can.

If there is jail time AND the girl is currently receiving SSI checks for one reason or another, (some minors can receive if they are in school and a parent is deceased or disabled) her checks would cease while she is incarcerated. Maybe that is what the employer was referrig to. I guess we will never really know. Read up on SS law to find out more.
