a follow-up eBay question

So... my pkg arrived today, but inside was the wrong item (part of the same line of products, but an item that I have no use for).

Msg'd the seller; I know that with the holidays I'll have to be patient for a response. I'm OK with that.

But when I scanned the "resolution center" over on eBay just to see what the standard procedures are there (no reason yet to file a complaint there, obviously), I'm not OK with something I read: It's likely, or possible, that when I return the wrongly-shipped item, I have to eat the return shipping cost, unless the seller (who messed up in the first place) agrees to pay that?

That is the return policy, though good sellers with business savvy who want to please their customers will pay for return shipping when the error is theirs and not the buyer's.

If you paid through a CC and not paypal, the CC will return all of your money if you file a dispute stating the item was not the one being advertised.

And sometimes you'll not even be expected to return the item for your money to be refunded.

I'm pretty sure you can open the auction link- there should be some where that says the item was wrong; not as advertised. I did it with a leather bag I got over the summer. From what I remember of what I read back then; the seller can lose their selling privileges if there's 3 complaints. The lady I bought the bag from had a bunch of wrong listings where her photo & description did not match.

Hopefully someone with more ebay knowledge can comment about this. The seller ended up paying return shipping because she didn't want the ding on her profile.

"That's good advice, but if you really want to avoid a bidding war and want to win the auction: enter your highest bid in the last 60 seconds of the auction." RB> Nonsense. How does that give you any more control over the auction than if you had entered your high bid 5 days earlier and just relied on the Ebay proxy system. The winning bidder will always be the guy that enters the highest bid. I've read posts about last second bidding from a lot of guys and my sense is that they really don't know what their maximum price is. It's a win-at-any-price mentality mostly. "This will enable you to take complete control of the auction on your terms, and force the highest bidder to pay his maximum bid." RB> Again, how is this any different than entering a bid and just relyng on the proxy system. Some of us find it exciting to sit with sweaty palms finger ready to hit the enter key at the last moment. But it makes no difference to the outcome. You could automate the last second bidding buy paying for bidding software, but it does the same thing as the proxy system. "Some people may consider this method a little unethical, but it's only business. Worse things have been done." A bid is a bid and whether it is entered 5 seconds after the auction opens or 5 seconds before auction close is irrelevant to the outcome. The guy who is willing to spend the most will win.

The biggest problem for the buyer is that she only has 45 days from date of purchase to open a case in eBay. If she seems willing to work with you, I would encourage her to wait until close to the deadline and then open a case. That way, she has protection if the item isn't delivered, but you don't have to refund her money right away. However, you risk receiving negative feedback with any delay. You'll have to judge how frustrated or accepting the buyer is with the delay vs. your willingness to lose your money and the item. As other posters have suggested, keeping the buyer informed as to the steps you are taking is always reassuring to the buyer.

I would suggest filing a non-paying buyer dispute. You have 45 days from auction's end to file. In order to close a dispute you must take additional steps besides filing the dispute. If you leave a dispute in limbo, then it is automatically closed after 90 days and you have no recourse and you don't get your fees refunded. If the buyer doesn't pay, then close the dispute by saying you no longer wish to communicate with this buyer. This gives her a strike, which is different than a negative feedback. 3 strikes and a member is kicked out. I would not offer a second chance to the next bidder unless a dispute has been filed. Your buyer could file a dispute first and claim you were a non-performing seller and sold the item she won to another bidder. It's unlikely this buyer would do this, but it has happened in the past. Talking about past options...it's not the end of the world if you get an undeserved neg. You simply post a reply and state that the neg was left in retaliation and give the facts. Those that take the time to look at feedback can see the true story. Now, eBay has changed the rules and we won't be able to do that.

If you add it to your "watch" list, you will be able to see the time left for the listing. It really is small in size, isn't it?. Why didn't I think of that?? (Because I have the KT, and I'm spoiled.) Yes, it's awfully small, and faded, I'm sure. It would be nice to have, but for not very much money. I have some similar memorabilia of his. I have no idea what "lg" means. Certainly not "large." LOL I found it because I have a standing search request on eBay for any items that contain the word Luckstone, and also one for "Alice Campbell," my grandmother (his wife) and also an opera singer. A different Alice Campbell was a novelist from around the time time period, so unfortunately I get notifications whenever her books are listed on eBay. But no big deal. I bought another picture of my grandfather on eBay--not his most flattering, but an interesting photo. I also found a listing that claimed to be selling a photo of Harry Luckstone, but it wasn't him. I wrote to the seller, who ignored me. ;-)

Roselvr, the OP can easily prove the wrong item was sent simply by taking a photo of what she received and showing eBay that it's not what she won in the auction. But it can become a "she sent" versus "buyer substituted" issue. (Amy can testify to that.)

The return shipping charge is in a grey area. The policy is that the buyer is expected to pay for the return and it's assumed the return is because of a change of heart regarding the purchase. When it's the seller's fault, it's not always clear about who will have to pay.

Well, so far my communications with the seller have been good, so it doesn't look as if I'll have to pay anything to send the wrong item back (one I get the correct item). She was very apologetic.
