Question for Chimney Experts

Hello Experts.

I have a 23 year old HVAC setup that I am replacing.

I am putting in all TRANE equipment(condenser, coil and furnace) that uses R410 refrigerant.

Currently my old furnace and boiler are next to one another and share the same aluminium sheet flue for venting. The bolier is not being replaced, but the new furnace will be a TRANE 80K BTU 80% Efficiency furnace. The reason I am not going to higher efficiency and BTU is because I can't do PVC vents.

MY QUESTION: WOuld there be any issues for the new furnace to share the flue with the old boiler just like before? Or should I be looking at replacing or working on the flue/chimney? The contractor on one hand says everything is OK and there is no problem sharing the exisiting flue as is but on the other he has put a clause in the contract that he will not be responsible for any chimney related issues arising out of inspection after the install. Why would he put it in contract if he thinks the current flue/chimney are fine. Please advise.
