Dave or any other Mortgage guys! Refinancing ??

My husband and I bought a new house last year, and have decided to refinance to take advantage of the great rates. We expect to drop 1.375 interest points and about $200 a month. We should recoup the closing costs within a year, and plan to be in the house 2-3 more years, so it sounds like a good deal.

We are going with our existing company and doing the streamlined refinancing. Here's the one snag (maybe?) we've hit.

When we bought our house, we didn't have much money for down payment, so we did an 80/15/5 loan, to avoid PMI. Put down 5%, and then had 2 mortgages for 80% and the 15%.

My husband's uncle wanted to help us out and agreed to loan us the money (at interest of 3%) to pay off the 15% trust. We tried to do it before we signed the papers but it would have been a "gift" etc, and we didn't want to get into that mess, so we just signed the papers, waited a month, and paid off the second loan with no penalty. (& we send him a check each month)

With the paperwork for the refinancing, there is a question whether the house has a second mortgage, home equity loan, judgment, or liens, against it? Then if so, they want the information about it. In our situation, it's not a second mortgage right? Would our second "private" loan be considered a lien? Technically DH's uncle owns that "piece" of the house, not us. But on the other hand it seems like it should be a personal loan between us now & nothing to do with the mortgage company, since they got their money? I'd prefer not to tell them about the uncle's loan, (seems like things would go easier) but if we have to, then we have to.

Then if it is considered a lien (or one of the other options) the mortgage company talks about a subordination clause. To me, it sounds like they want to combine both loans, so we can pay off uncle, and have one outstanding loan with mortgage co. But that's not a good option for us, since our loan with his uncle is only 3% (much cheaper then what any mortgage co would give us) and seems like our monthly payment would go back up.

Would they let us keep this "private" loan and still do the refinancing for us? Or have we created a situation they won't like/allow?

So, I guess my two basic questions are:

1. Is our uncle's loan considered a lien or something like it?

2. What is the subordination clause about?

Sorry this post turned out so long, but I appreciate any help that you can offer.

I don't know exactly what a subordination clause is, but in general, they like you to pay off the second mortgage with the refinance. Your uncle's loan is not a lien. It's only a lein if you default on the loan, and he takes you to court, and puts a lien on the house. The purpose of the lein is to make sure that they get their money when you eventually sell the house. Anyone who you owe money to can have a lien put on your house, not just someone who holds a loan secured by the property, BTW.

Do you have any documents for the loan with your uncle? If so, does it say that the loan is secured by the property? If not, then this is a personal loan. It makes no difference that he lent you the money to pay off your second mortgage. You will probably have to disclose this loan to the lender, as they will want an accurate picture of all your debt, so that they can be sure that you are capable of paying back their loan, along with all your other debts, with your current income. Just be sure that they understand that this is a personal loan, and there is no existing documentation saying that it is a secured loan.

Don't sweat Uncle's loan if he didn't specifically secure a lien against your property and record it at the county. You'll be fine!

I have a Minnie Royal/ Royal Lee pair in a raised bed that went in earlier this year. Fingers crossed. There is actually a commercial variety of low chill cherries that I would LOVE to get my hands on but they sell only to commercial growers. They are known as the "little darlings," Royal Edie and Royal Helen. They fruit later than Minnie/Lee. I have not tasted any of these myself. I'm hoping to have five or six raised beds with 4 in 1 hole. Hi JBSpook, Dave, do you believe fixed rate mortgages will get down to 4.5%, even just for a short time? We've ALREADY been grabbing locks on 30 FRMs at the 4.5% levels, and today we saw it as low as 4.375 (par, no discount points.) For the patient who get their financial files pre-prepared with a good lender (as described above... and "advisory" type, not a 'loan salesperson') I foresee the potential (knockon wood) of possibly capturing 30 FRMs at the 4% flat level. Those that your company is floating, are they looking for 4.5% with, or without, points? Well... it depends (you knew that was coming, no?) The clients we have that use our "target rate-lock watch" service name their own target interest rate and desired point structure (with our advice, if they want it.) Our service fee for this daily watch, and ultimate completion, is rolled inside the financing (almost always equity-paid, since the rates are too cheap to make sense of paying in cash, or a rate-premium (also known as "reverse points...)) so ultimately they get EXACTLY what they are looking for (without any surprise costs) if/when the market puts us in the position to get an advanced negotiated lock out of the lenders. Our firm's in a bit of a unique position with several funding lenders because over time our volume, along with the quality of the client files we package, has let us grow a reputation for delivering certain quality to the lenders. This gives us a bit of additional "rate-lock negotiating pull"... especially when they know we can deliver to them a streamlined closeable file that will take very little administrative effort and cleanly be re-sellable to Fannie or Freddie. Since virtually 100% of our clients come in to us on an advisory basis, they tend to be of a higher quality themselves, and later cause much trouble (defaults, disputes, etc.) to the servicing departments. We currently have clients with target locks set for rates from 3.75% upwards... on both 30 FRMs and 15 FRMs. Of course... those with the lowest rate targets are fully aware, and accepting, that they may completely miss out if the rates don't reach their levels... but they're OK with that. Lien releases are recorded at the same place that handles deeds & other liens such as a mortgage. Not every place is as Dave explained, "The lien release ought to be recorded by the title company at the county..." In fact, I've never lived anywhere where the title company had anything to do with recordings/filings. Title companies are a commercial company peforming a real estate service but are not a governmental agency responsible for filings. Here, in CT, each town handles their own real estate recordings. In many states, recordings are at the county level. Also, your sister's mobile home loan isn't considered a real estate loan unless she owns the land & there's a permanent foundation. Rather, it falls into the secured personal loan category because a mobile home is like a car, personal property. In my area, a lender on a mobile home holds the title, same as if you have a car loan, until the loan is paid in full. So, you need to find out how mobile homes are handled in your state...state level, county level, town level, or lender. Restructuring of a mobile home loan... This would be the same as a distressed car loan (mobile homes can be repossessed same as a car). Your sister just needs to phone the number on her payment statement. She should explain her situation & just ask for a loan modification. In all probability, with documentation of the hardship, she'll receive the modification. My best to your sister. /tricia

For those who didn't follow the other thread, you aren't just trying for a traditional refinancing. You are trying to take advantage of one of the government programs. The program is specifically designed to help homeowners refinance on more favorable terms so they can stay in the home. Rental properties are strictly prohibited in the program. You are trying to skirt the law and take advantage of some "free" money from the government and are speculating that you will be able to make money as the condo market improves. Frankly, oversight of most of these government initiatives is virtually non-existent, so you probably would be able to get away with cheating the system. However, you are still trying to cheat the system. You know that your intent is not to use this is a primary residence. Whether the state could prove that in a trial is a question best left to a lawyer, but you know darn well what your plan is. It sounds like you still have a bit of the same mentality that got us into this housing mess to start with - and the bank sounds like it didn't learn a darn thing. The bank should not encourage you to lie on mortgage documents. You should not lie even if a dishonest banker says it is ok. Even more, you should not speculate in the condo market unless you have some serious money to do so. (Planning to own/rent property on small timescale is speculating!) Lots of people just tried this plan and are now facing foreclosure. Count yourself lucky that you are in a position to get out of this place with your shirt still on.
