Installing Win7 upgrade on clean Hard Drive

My PC is getting pretty glitchy and I'm thinking of reformatting the hard drive. When I do that, I'd like to install Win 7 instead of Vista, which is on the drive now. According to Microsoft, I qualify for the upgrade, which is much cheaper than the full version of 7. I know it is possible to do a clean install from the upgrade version but, will I run into trouble when the upgrade version looks for an older version to qualify me for the upgrade? I don't have OEM disks for Vista because it came preinstalled on the PC. How will I convince vista that I'm "legal" when I do a clean install?
