Builder retainage question! Please HELP

I need your advice please. We moved into our home more than two months ago and had a 4 page punch list. SOme items were addressed but many are still not. We would like to retain $8,700 from the builder for work pending with the promise that payment will be made as the items on the punch list are completed. He feels that we should retain $2,500. he has said that if we don't pay the rest of the money, the subs will put a lien on our home and we may have to pay more than we expected (since it is a fixed price contract).

We asked for a schedule but got a list of the punch list items with a bunch of TBD next to them. We allocated amounts for each of the items based on how much it would take us to get someone to complete the items. Our builder is being so rigid on this...he refuses to take the final draw payment till it is the amount he wants (with only $2,500 retainage)I am not sure what to do. WWe have assured him that he will get paid as the work gets completed...and we have been arguing for a week when we could be getting subs in to complete the work and get paid. We feel like this is our safety net but we don't want companies to put a lien on our property. Shouldn't our builder be holding money from the subs for work not completed, just like we are holding it?

Please help!!
