Unprofessional Structural Engineer

Hello wise forum members!

We are in the middle of an addition/remodel project for our home and have run into some issues with the structural engineer on our project. Hoping someone here may have some advice? (Apologies in advance for the long story)

Part of our project involves an addition to our existing home which would require that we tie in the roof over our addition to the roof of the existing portion of our home. After receiving approval on our plans/calculations and several weeks into construction, it was discovered that the assumed height and pitch of our existing roof was not accurate. We would need to rebuild the existing roof to a higher pitch in order for it to match the new roof and accomplish the ceiling heights that we'd planned for. So we informed the structural engineer of the issue and asked that he provide the calcs needed in order for us to do so. His response was that he already had a lot of work on his plate and had just had a baby. His priorities had changed and he didn't have time to work with us. We had two choices: tear down the new roof and rebuild that to match the existing roof's pitch (which would mean his calculations would still be valid and he wouldn't need to do any further work) or find a different engineer. In an effort to keep the project moving forward, we paid for a different engineer to provide calculations for the portion of the roof that would need to be changed. Now, we're being told by our city that we can only have one engineer of record so we're also faced with paying the new engineer thousands of dollars to review all of the original engineer's calculations and assume responsibility for the entire project.

We feel like our original engineer has essentially left us high and dry and he hasn't exhibited any concern for the thousands of dollars that we'll need to pay because he didn't feel like finishing our project. He's been belligerent in all our communications.

Would this be considered negligence or violation of a code of conduct? Is there any action we can take?
