My best suggestion is that you figure out your priorities. You may want great insulation and a durable roof that looks good, and you may want it all for cheap. You probably won't get all of this. If you don't prioritize then you won't know where to compromise, and you'll keep going in circles. Also, try and find a professional to work with who actually understands the way your roof is supposed to work, or else you'll just be throwing money away. For example, if your roof is ventilated then any insulation you put on top of the existing sheathing will be pretty much useless. You probably need a smart general contractor, not a roofing company.

I am sorry for resurrecting this thread after a couple of days. To the OP, you should decide how important this issue is to you. All of our advice for you is predicated on our assumptions and biases. I too hate two story entrances and thus consider this an improvement, but that doesn't mean you should not pursue this. Next, if you decide that this issue is confirmation of existing reservations with this builder or is something you can't accept, then speak to an experienced attorney in your area. That attorney is likely to have some perspective on the builder and the legal decisions in your area that we don't have. Personally, I think the quoted clause is laughable. Finally, contracts often contain language that all the attorneys know are unenforceable. You can add any outlandish thing you want to a contract and regardless of whether or not it is enforceable, it can work to discourage action and solve problems when people read that and decide not to take action. The quoted clause would allow the builder to sell you a twelve bedroom mansion and construct a two bedroom shack and claim the plan as built prevailed over the blueprints. Obviously, that is ridiculous and not going to happen. Generally, you have to know what you are getting when sign a contract. There are certain reasonableness tests that apply, for example, moving an HVAC vent 6" is not going to breach the contract. Adding a room to a house when you wanted the space open seems a bit of a stretch of reasonableness to me. This is not to say you should run and challenge the builder. It is to say that you shouldn't throw your hands up in defeat before consulting professionals in your area if it is that important to you.
