Should Apartment Have Liability Insurance?

I have just been forced to move from an adorable little apartment in the perfect part of town for me. After having lived in my unit for two years, I had the misfortune of falling on a very wet and slick patio floor just outside my front door and wound up with a badly broken ankle. The manager went INSANE and immediately began yelling that they didn't have any liability insurance because she had screwed up and let the policy lapse. And she flatly REFUSED to pay any of my medical expenses, which turned out to be considerable, or any other expenses resulting from my inability to walk for four months. She then started harrassing me constantly and threatening to evict me because she said I had too much stuff in too small an apartment, that my apartment was filthy, that I was a menace to the other tenants, and that I had an extra cat. (Actually, I did have an extra cat, which I took in from my best friend when she was dying from pancreatic cancer!) I lived that nightmare until I was nearly suicidal and finally got out of there two weeks ago. Has anyone else had a similar experience?

Wow, that is one heck of a story. Yes, apartments are usually required by law to maintain insurance policies on the common areas.

In most areas tenants are strongly protected by law - there are strict requirements on insurance, reasons to evict someone, required notice, etc. You should absolutely consult with a lawyer.

Note that everyone's advice here may not be valid for you - landlord/tenant law varies a LOT around the country, though it is usually strongly biased to protect the tenant.

You have a few issues going on here. The first is the slip and fall. Insurance protects the property owner but it would be up to you to prove that the landlord was somehow negligent. Assuming you prevailed in court and since the property owner didn't have insurance then you might be able to go after the assets of the owner. Depending how the business/real estate is structured there may or may not be assets to go after. That's what you talk to a lawyer about. There are time limits so if you want to pursue legal action, do it sooner rather than later.

As for the issues afterwards, my best advice is to put them behind you.

Certainly if you sell anything you want liability insurance, as someone can trip over something and sue. You would also want product liability to cover the instance if someone got sick OR CLAIMED THEY DID. Anyone can sue for any reason or no reason and the insurance would give you a place to turn to to defend your case. Plus, if you were deemed to have some liability for the whatever, you'd be covered as long as you weren't negligent. With my insurance company in Pennsylvania, I can get a rider on my homeowners for only about an exta $30 a year. This gives me liability and product liability, at my farm stand as well as at Pennsylvania farmers markets. However, if I go to a New York State market, I would not be covered unless I switched to a farm policy which would cost me twice as much as the current homeowners. Each state and insurance company has different rules which you should check out by going to a couple or more insurance agents to see what they can give you. I personally don't want to risk losing everything by someone who is suit happy, so have the inexpensive rider on my homeowners. Also, regarding pickles or whatever, in PA you are required to have a certified kitchen (through the Dept. of Ag). In some states, acidy product don't require a separate kitchen and you can get a home kitchen certified with water tests and certain other standards. Usually you are not allowed to have household pets that have access to the kitchen. Some states may do their certifying through a Health Dept. Unless you are in the home building business, and planning to sell the home you are currently building, do not waste your money on a General Liability Policy. You can't sue yourself. If you have a homeowners policy on the home you are living in now (while this one is being constructed), most carriers will extend premises liability to the property under construction. This will cover slip-and-falls of the trespassers who hurt themselves on your property. If you do not have a homeowners policy, or your carrier balks, ask your agent about an O.C.P. It is MUCH cheaper. You must, must, must secure certificates of insurance from ALL of your subcontractors which evidences General Liability (including completed operations) and workers compensation. Work comp is the most important. Certificates are issued by their insurance agents free of charge. Make sure they submit these prior to showing up to the job site. Hope this helps

This is what happens to you when you try to do things right. If you want to have some more fun, call your mortgage company and tell them that you are going to start a business in your home. (If you take out a business insurance policy, the mortgage company will, of course, find out that you did that, because they require insurance to be in force as a condition of your mortgage.) There are probably provisions in your mortgage that prohibit turning your home into a place of business. Your city officials may have something to say about it as well, even though you won't have any sign or other exterior evidence of "a business." Before you call anyone else, read your existing homeowner's policy over VERY carefully. You may well find that there are loopholes that could allow occasional business use of your home. It's not like your husband is going to put up a big sign and turn your house into a full-scale business. (Zoning wouldn't even allow that, of course, unless you already live in a commercially-zoned area.) Many of the things people do are probably in some technical violation of a mortgage, insurance policy, or local zoning rule. I'm not saying this is okay, or that people just should ignore these types of things, but there is a reasonable threshold of common sense you have to consider. My position at this point would be that what your husband proposes to do is on a very small scale. If it really takes off and he has customers showing up every day, he'll probably want to take this out of the home into a proper commercial location anyhow.

Hello, all my friends,
Yes, it's a whacko story, indeed, and now I'm about to be sued for over $11,000.00 in damages to the apartment. The place was only 400 sq. ft., and to have damaged the place to equal that amount, I would have had to set fire and burned that wing to the ground. There's only one move for me at this point, which is to file a tort case due to physical injury and sue for physical and punitive damages. And this was NEVER my wish. I've only wanted to put this horror behind me, as I'm a very shy senior citizen who's greatest hope is to enjoy to the fullest my well-deserved retirement. My thanks to Phideaux and Mike for their kind comments, and may you all stay tuned, as something tells me this sh - - storm isn't quite over.
Oh, just a little more: I totally LOVE my new apartment! It's over 3 times the size and with all kinds of amenities, whereas before there were none! And had I mentioned that the teenie-weenie place didn't even have an OVEN? When I signed the lease, I asked the manager why no oven was installed, even though they did offer a "range-top." The leasing manager told me that an oven was a "fire hazard." My fellow Webbers, I'm completely unable to make up this "stuff." Are you getting an idea of the mentality of my opponents? Geez Louise, what a world we inhabit.
