I thinkdobermom is right they are getting back at you for complaining about the noise mess and bugs. you were with in your rights to complain if roaches were coming in your apartmet because some one else in the building keeps there place like a hog pen. grated they have the right to live how they want and do what ever they wnt when ever they want but those rights end when it effects your rights. that includes your right to live in the clean safe place you are paying to rent and your right to quiet enjoyment. check with you local law enforcement and find out what time load noise is prohidited, usually its after 10pm to midnight on to 6 or 7am the next morning. then when they make alot of noise after that time, say at 12am or 2am call the police on them since they are in general disturbing the peace by violating the local noise ordence and also call the landlord and let them know the police were called and why. if you do that a few to many times you landlord will get tired of it and either let you out of your lease so you stop complining or give the others notice to leave if he is smart.

Thank you all for your suggestions. Believe me, being able to vent my frustrations here at 1:00am really helped. I've really been a mess over this. I try to keep perspective, but after months of sleep deprivation, it's hard. Maybe I was a little pissy in my last post, but it was my birthday yesterday, and just wanted to have a nice day instead of it being ruined my these issues. You are right - a large part of the problem is shoddy construction. I do understand that my noise is annoying to my downstairs neighbor. That is why I've been trying to be as quiet as possible. I know that he was probably startled by it. His complaints are valid. But I also feel that I should be able to make a bit of normal noise at 8:30 pm, when I am very quiet 99% of the time, and never late at night. By the way, my upstairs neighbor walks around in heels, vacuums, moves furniture, and blasts music (in weird one minute intervals) from 11:00pm to 3:00 am after I have repeatedly talked to her about this. I don't really care about the rest of the day in terms of cleaning, walking and guest noises -just the night. She openly admits to being loud late at night, and has told me 'I will do what I want, if you can't deal with my f*-in schedule, then move'. That is why I think she is slime. I left a long message for my landlords this morning. They immediately came over (while I was at work), and talked to my downstairs neighbor. They will be coming this weekend to fix the floorboards - I am so relieved about this! I agree that he was out of line last night. If he continues to complain and slam on my floor once the floorboards are fixed, then I will definitely say something to him. My landlords then went upstairs and talked to the female tenant about being quiet between 10 and 7am. She was completely rude and arrogant to them, and told them that she will do whatever she wants whenever she wants. So, they went to the police and gave them her name - the police said to call them if she does anything really loud again. They then went back and told her they did this, and I think it really freaked her out. (oddly enough, my landlords told me that she had a black eye. She also told them she stopped working, doesn't care about getting a job, and will live off the money she gets from her 'other people'. Don't ask me how she can afford a Lexus. Must be nice.) Sorry to speculate. It's just strange. Again, I don't really think that the police route is the way to go, but if it will scare her into being more considerate..... My landlords also told me that they have a potential 'rent with option to buy' house that I am going to see tomorrow. I think it's out of my price range, but they are actually willing to rent it to me at the price I'm renting right now, for the first few months. I have really great landlords, I have to say. I really appreciate them. They did not have to be so proactive about this, but they did. I really called them just to make a complaint, and to talk about getting out of my lease. Instead, they immediately tried to remedy the situation. I know that there are a lot of awful landlords out there, and I am lucky to have people that actually care about their tenants. thank you all so much! I'm pretty sure she knows that it's way too loud. She doesn't actually believe the maintenance guy is racist, if she does then she needs her head examined. I think she's stalling because she doesn't want to kick out paying tenants. I've actually tried to arrange something with the manager, because my neighbors usually start up around 6:30pm, half-an-hour after the office closes and all-day on Sundays when the office isn't open at all. The problem is, the office is usually closed by the time I get home from work. Tuesdays are the only days I'm home before 6pm and I think they've caught onto my pattern because she's always busy now when I show up and she's off on Saturdays. I've left messages with her assistants but she's totally dodging me. I sent an email to the regional manager last night, I don't have their phone number and can't find it for the life of me. It'll probably be a week or so before I hear anything back. As for my neighbors, they're friends with the people who live next door to them. The guy who lives above them is deaf (I'm not joking he's actually deaf). The woman who lives directly across from them works evenings and doesn't get home until midnight, but she actually told me that she can sometimes hear their television in her living room during the day, but she doesn't want to get involved. I think I can work on her and she might be willing to talk to the manager, if I can ever get a hold of her, but I still don't think my manager will do anything. If the regional manager won't get involved, can I break my lease without shelling out the subsequent fine?

The landlady sounds like she'd work with you. I wonder what it would sound like when it IS you and him yelling. Would it be worth it to do an experiment, that the landlady and your complaining neighbor stand in his apartment, and you and BF go in YOUR apartment, and yell really loud at each other (not mean yelling, of course; say stuff like "you're the coolest guy I've ever dated!" or "I really love the Red Sox!" or stuff). Bcs I'm wondering if the neighbor would say, "wow, that's much louder than what I'm hearing" or "that's not the same voice." You might also say to the landlady that, since you KNOW it's not you, you weren't even home, you can't keep your eyes open at 4a.m. to HAVE a fight, you are WORRIED ABOUT YOUR NEIGHBOR'S HEALTH. His mental health, and his physical health. He may be hearing things that don't exist. Is he dreaming very powerfully, or something? Or could the landlady insist that, the next time your neighbor hears "you" yelling, he should go and stand outside your apartment door, to see if it sounds the same right there. Maybe if he went out in the hallway, he'd realize it's coming from some other direction. It would be hard to tell when the neighbor is going to hear stuff before he hears it, but you could also just make it a policy to set up your camcorder or something each night to spend away from home.
