RV being evicted

I was wondering if anyone else has had trouble with their neighbors or more importantly their Home Owners Association regarding RV parking/storage on their property?

We have an HOA for our 8 year old development (single family homes) that was strictly for caring for the front of the development, Open Spaces and the Tot LOt. It only cost $35 per year to begin with. It is presently up to $100 per year.

Our trailor is parked on the side of our house behind a 6 ft privacy fence and is considered within Township Limits for storing vehicles. Our New neighbors do not like it. They got involved with the HOA and he is now a board of trustee. They are trying to amend the by-laws to prohibit all trailers/boats over 7 feet in length because they feel the looks of these types of vehicles detract from astetics of the development and will result in lower Real Estate values. Hog wash!! I have fought them so far and they've decided to "Grandfather" me in. But it still bothers me.....Why shouldn't anyone that buys into our development be able to park their boat or trailer on their property. This is the reason I did not buy into a townhome.

Any advise or experience?

Why in the hell people want to pay to live in such conditions is beyond me.

What would they say if I were to move in and park this beside the house?

NO WAY would I buy a house in a place where the neighbors dictate what I can and can not have on MY PROPERTY.

Sale the dump and find a home in a new location that will let you live FREE and happy.

In NJ housing is at a premium. We bought here because there were NO rules like that, its just a new neighbor who is causing all the problems.

While you pictures and opinions are welcome, they don't help me with the problem I am having. I am trying to find someone else that may have thwarted a similar bylaw change.

p.s we have a 5 year plan, moving to land we bought in NC when DH retires. Cannot move prior to this.

Yes, I get mobs of TRES and I worry each time they will ovewehlm the other birds but they don't. In my yard I have two boxes paired (about 30 feet apart) on the east side of the house, then in the back yard I have two boxes paired on the west side of the house and in the front yard I have two boxes paired on the west side. The boxes on the east are sortof in sight of the boxes in the back west side (a big tree is inbetween) and are about 68 yards from them. The pairs of boxes in the front west are in sight of the boxes in the back west and are about 64 yards apart. I normally have three or four pairs of TRES nesting and a pair of Blues and sometimes a pair of Dees too in our yard. Then I have three boxes at the back of our lot, not in sight of any of the yard boxes and are over 100 yard away from the yard boxes, these normally have two pairs of TRES and one pair of Blues. Then about a half mile away is a park where I had five (now seven) nestboxes. I normally have two or three pairs of TRES and a pair of Blues, may be different this year with the extra two boxes. So as you can see we have lots and lots of TRES in the area. They were mobbing the Blues yesterday but mom is incubating what I think are five eggs so I am not too worried about the TRES this year since the Blues are so far ahead. Weather has been pretty cool here lately so the TRES aren't real serious yet. Last year the TRES kept chasing away the Dees from the paired box (TRES wanted one and the Dees had started a nest in the other). I added a sparrow spooker and the TRES just used it as a perch. The TRES didn't deter the Dees at all though and once the Dees laid their first egg, I added a wren guard. By this time the TRES were nestbuilding so they weren't worried about the paired box anymore. Good luck, hope yours Blues renest! Donna

The boxes were actually in the bedroom when she told me to remove them.they were stacked atop one another against a wall.She said "fire hazard" and gave me a week to unpack what was inside.I already had a few pieces of audio equipment in my living room and when i unpacked i added more..nowhere else to put it.I made certain that it's all organized well and polished of any soil and not obstructing pathways in or out of the room, 'nor blocking access to the window. i'm not a messy person but when she inspected(initially),she found the kind of stuff that most of us wait til we move out of a place to bother cleaning.I've lived here nearly 4 years now ,so i admittedly did have some legitimate cleaning to perform..It was when she voiced her dissatisfaction with my 'stuff' that i got angry as well as fearing eviction.She stood in my entryway yesterday,(the re-inspection) looking at my 'stuff' and says " it looks better..but..you DO know that the state inspectors are going to be in here on the 31st!?..)I simply nodded and very casually or matter of factly said "yeah"..it was a kodak moment. I want to thank everyone for their response.i feel 100% better now.I spoke to a few people(acquaintances) at the local Denny's this morning shortly after my initial post here and they told me how absurd my manager's notion sounded to them,but i still felt panicky..The responses here put an end to that panic..Thanks again to all of you who replied.btw,i never bothered to move my vinyl LP's..They're still in the bedroom.Classic 60's 70's and 80's fire hazards don'tcha know! I think people are making this way, WAY more complicated than it needs to be. Is the 22-year old on the lease? I assume she is not. If she's not, THEN HAVE THE LOCKS REKEYED and "evict" her, and stop worrying about the legal ramifications. She's 22. She's a heroin addict. She may SAY she knows her rights, but trust me, unless she is a law school graduate with a very well-off sugar daddy/pimp who'a willing to waste money on legal fees, she is going to be in no position to fight your mother-in-law on this. The only real issue at hand is this girl's mother being willing to do the hard thing, draw a line in the sand, and stand her ground on this, with no exceptions and no excuses. I work in the addictions field and hear this story every single day, with families calling and wanting to know how to "help" their adult child who won't move out, steals their money, wrecks their car, keeps getting arrested, and won't stop using dope, even though "he promises us every time he comes home that he's going to get help. What can we do?" The answer is simple-- stop being an enabler. Stop giving them money, and food, and a place to sleep, and keys to the car, and excuses to the cops when they call wanting to know their whereabouts, and bail money. JUST STOP. It's that simple. Unfortunately it's never that easy to put into practice, but THERE IS NO OTHER WAY TO DO IT. Your sister-in-law is just using statements about her so-called rights as another way to manipulate your mother-in-law. Please don't feed into it; tell your mother-in-law to have the locks rekeyed and get her out. NOW.

Basically, it sounds like you chose the cheapest apartment possible. Surprise surprise, it is not the Taj Mahal. Instead of getting evicted and thus destroying your credit rating (making it unlikely you'll ever get a decent apartment, or borrow money for a car or house), take the initiative and try the following: 1) "The LL fails to repair the sink (inadaquate and insufficient presser of hot water)" Some areas just have low water pressure, there is not much the landlord can do about it. If water pressure is fine other places in your apartment (like the bathtub or kitchen sink), you might have a corroded faucet. Call a handyman and change the faucet. Use some of that money you're saving on rent. 2) "He also fails to replace the window screens that he promised to do so from the last september." It is winter, you don't need window screens. In the summer, for about $5 you can get the materials you need to fix them yourself (basically, nylon window mesh at home depot). 2) "There are rats running around on the ceiling and I can hear them biting something every other times when i try to go to bed." Call an exterminator. 3) "The bigger part of it is that my neighbor in the next building play their music loud" and "The neighbors are play music or watching TV loud in the afternoon. I know it is afternoon, but every person has diffrent shifts and jobs." A tenant in a different building is bothering you? How is this your landlord's problem? Call the cops. 4) "Hot water in the bathroom only last at most 15min." Again, you aren't in the Taj Mahal, but perhaps try to keep your showers under 15 minutes (which is a long, long, long time to be taking a shower, by the way). 5) "Whnever i try to contact with him, he hardly picks up the phone and never call me back. I sent a letter about it, but he called it "a stupid letter" and ignored it." You're being a pain, so he is ignoring you. That's not surprising. 6) "I don't think I can handle with it in this place anymore, otherwise i will lose my life." Don't be so melodramatic. Living in a cheap apartment will not kill you. Should you have to do this things yourself? No, and in a better building you would not, but in a better building the rent would be much higher. If in the end you decide you want more luxurious surroundings, and are willing to pay for them, the put ads on craigslist.org and find a subtenant. I'm sure the landlord will be happy to get rid of you.

If housing is at such a premium. Why are you moving to NC when you get paroled from the prison that you are in now??

A place here called Teays Valley is full of so called premium housing in a 15 to 20 mile stretch of valley.. 350 to 400 houses that range in cost staring at around $175,000.00 and upwards to $750,000.00 in little divided communities. The thing is 75% of those house were build, sold and are now sitting empty due to all of the HOA rules and regulations. HOA telling people that they can not put up Christmas decorations, What color they can or cannot paint their house, What plants they can and cannot have..

If I wanted to buy a camper and sit it in the yard or park it in the driveway. No assjack would come along and tell me to get rid of it. Nor get rid of anything that I worked and paid.

In NJ housing is at a premium.. It may be but at what cost?

I will stay in my little log cabin on the mountain and live free and raise my kids to be happy and healthy.

One word of advise.
When you get out of prison and move to NC.
DO NOT try to tell people how to live and how things are in NJ. For they like us here in WV could care less.

Try posting this on some of the home forums like home disasters or another one. I've seen various posts over there relating to HOA's. Maybe someone else would have experience or advice.

Seafire, I know you don't want to hear it, but I want to save you the consultation fee with an attorney:
You bought where a HOA exists and are obligated to follow their rules. Period. Sorry bro, but that's why HOA properties s&ck, IMHO. And I feel your pain, I'm formerly from the Pine Barrens and live here in SoCal, "the whole world turned upside down".

Some nut got himself elected to Borough Council, and then came up with the bright idea to have no trailer, camper, pickup, motor home, etc., setting anywhere on private property!
Well, they came here to tell me i couldn't park my motor home out beside the driveway, along side the woods. I park it there, because its the only level spot in my property.
So, i pointed out that it is duly licensed, state safety inspected, runs, and it has to be kept level! And, i had no intention of moving it anywhere! Except to go camping, or travelling!
Way back, when i bought this place, i had signed all the papers, but the previous owner's house wasn't quite ready to move him into, so i told him that i needed his garage to do some auto repairs, but he could stay.
Good thing i did that, because that "Grand-fathered" me in so i could fix cars on my property, because the Township changed the rules, effective 2 weeks after i signed the papers!
Oh, i had to run them off several times, but they couldn't shut me down! My 5 ft. tall wife ran them off with her 410 shotgun one time!
And, i still work on mowers, trucks, cars, and nobody says anything! And, if they did come around with a HOA, i would not sign it!
