our grass vs neighbor

We have problem and maybe someone can help. We live in a housing dev. All the lots are graded flat on a slight hill. That means there is a 3-4 foot diff. in elevation between houses, also a 6' concrete wall. The neighbor planted cactus on his side next to the wall we planted a small area of grass. Now we all know water will run down hill and go where it wants. The water is on a timer and has been the same since April. (No issues) Sunday the Marshall showed up to our house because the neighbor said water had gone under the footer of the fence into his yard and ruining his cactus. Therefore, as not to cause any more problems we turned it off completely. He had said something during Monsoon about water in his yard but we had not watered anything, it rained for a week. So here is the question what if anything can we do about this problem. We like the grass and I think if it was just rock it would be worse. Any one got any ideas?
