What should I do? Trees planted too low

I paid a local nursery big bucks to plant 2 - 36 in. box ash trees and they are a little to low in the ground. Where the trunk meets the soil SHOULD be level with the surrounding earth, but if I fill the well they made, the trunk will be standing in water a few inches deep. My guess is that they will tell me it's fine, but I'm not sure what to do if they won't admit they made a mistake and do it right.

Also, have you ever seen a graft that did not have the same shape on the other side of the trunk? My ash trees are grafted trees. One has the "V" on both or opposite sides, but one has a "V" on one side and the graft is a straight horizontal line across on the other side. The graft shape is supposed to help with tree ID. Is it likely a sloppy graft or the wrong cultivar?
