There are many things that could be going on with this tree, including disease, lack of a specific nutrient, all the rain, and natural loss of lower branches. Without pictures including how it was planted, and more information it is hard to give you good advice. Post us some pictures. You should take some leaves and branches to your local extension service.
In the mean time look up Oak Wilt and Anthracnose on the web and see if your symptoms look like either of these.

IMHO .... in my z5.. which may as well be your z6 ... its LATE SEPTEMBER ...

come on .. leaves are going dormant.. and dying.. it is not really a time to be too concerned about them looking weird ... they will be falling off in a week or 3 ...

with my 6 weeks of drought.. and near 100 degrees ... the leaves of EVERYTHING.. look weird ... odd .. off ... some trees losing them w/o frost.. etc ...

also .. on such a young tree.. its too soon to be concerned about true colors ... i had a scarlet oak.. that didnt turn scarlet in a good manner ... for the first 5 years after transplant ...

my vote.. relax.. its alive.. and its late fall ... ignore them

I just thought that the color may indicate a problem, even if the leaves are on their way out. It kinda looks like anthractnose. We have had the opposite of Ken's summer. Tons of rain.Impman I don't think it's oak wilt, if that hits here, I'm SOL, I have many oaks. I will be getting a camera within the next week or two, if the leaves are still the same by then, I'll try to put up a picture.

That looks like a nutrient deficiency to me. Some chemical damage can do that as well. Got to wonder if the rain didn't prevent it from taking up nutrients as it would have otherwise. IMHO, take a soil sample next to the tree to your county extension office, and get a complete soil analysis.

Too late now but if you can't find the problem by reading the link bring some foliage to your local cooperative extension service next year.
Nutrient problems with trees are almost always due to factors other than the amount of nutrients in the soil. Most soils contain elements in ample amounts for trees.
Their is also a specific disease called Bacterial leaf scorch, which is different from the symptomatic leaf scorch. This does not look like Bacterial leaf scorch and is very unlikely to be so. Confused yet?

I will get some soil test bags ASAP. If it is the leaf scorch, it may be too much rain. We got the rain the southern plains didn't get, plus some. I was happy I didn't have to cater to the new seedlings and use a hose.

Umm, leaf scsrch is due to a shortage of water. So the next thing you need to do is figure out why/how that happened.

Among the things to consider are these:
How was soil preped at planting time?
Kind of soil it's in?
How long in a container before put into the ground?
Condition of root system?
Circling roots?
Trenched or dug nearby that removed/damaged roots?
High soluble salts?
