Keeping the dog out

I own a duplex and my tenants have a dog. Now I have to put up with this dog that poops ALL OVER THE PLACE. Including, going in my flower bed. I already have to watch while cutting grass. But, I'm drawing a line at my flower bed!

I put up a 2 foot wire garden fence from Walmart, but this big dog just pushed it over. To make matters worse, he gets tangled up in the fence. It ends up ripped out and looks real bad! I know that I'm not the only one with this problem. So, I'm hoping that everyone here can help me with this project.

I want to build a fence that will keep the dog out but still allow people to look at the garden. I do not want to "spray" the area with anything as I don't have time every week to re-apply a product to the area. So, I'm wondering how tall the fence should be and how far apart the 2x2 pickets should be. If you could share your ideas, I would really appreciate it.
