KJ I think it’s an easy task, especially with a young rose you planted yourself . In zone 9B, you can plant high above the graft and any Huey that pops out below the bud union will be very obvious, just snap it off completely when you see it. Claire those reasons make sense to me for cold weahter locales. If it dies to the ground, the rose will come back true to variety. In my mild winter climate I always plant as high up on the root system as possible because all the best soil is on top (there’s a reason it’s coalled topsoil lol!) , so its not wasted on the graft and can be used by feeder roots. Also, I don’t have to dig so deep into the much harder adobe clay below. I am quite opportunistic and get whatever rootstock comes my way! With good care and a benevolent climate, the great majority of roses thrive regardless of own root or whichever rootstock.

Thank you nummykitchen. The colors certainly look like Tiffany to me. The greens are not the same but I'm not really after the same exact rose. The colors and fragrance are what interested me. I can smell these roses as far away as the sidewalk when I walk past my neighbors yard. I just fell in love with the them and since I got the clippings the day my mother passed away it has meaning to me. She keeps telling me to come into her yard any time and cut some roses but I don't feel right doing that. I had been looking all over for a rose that looked similar (finding the exact rose would be a shot in the dark) but wasn't finding anything remotely close. So glad I asked here. I'm going to put the Tiffany rose on my wish list. I see that heirloom roses carries them.

That's easy, Susan. Heirloom likely listed Lincoln as "Mr." instead of "Mister" for the same reason we usually write "Mr." instead of addressing something to "Mister". Whomever entered the information wasn't being careful of the patent information. It was likely just expedient. A patent provides legal protection for the specific rose, no matter what it's called. Any plant of that specific rose carries a legal obligation for royalties to be paid. You have one year from the first proven "introduction" of the specific rose in which to apply for a patent to protect it. If I post on line or in print, anything identifying a specific rose I am considering patenting. that "starts the clock". I have one year in which to apply for the patent or my time limit has run out and it can't be patented. A trademark provides legal protection for the specific NAME, not the plant. You can sell the plant as any name you wish, except the trademarked one, without paying anything for the privilege. The legal obligation to pay for it only exists if you call it the trademarked name. That is what Austin did with the early varieties which were brought to the North American Market prior to his having any distribution system here. Hortico, among others, sold Tamora, Heritage and all the others Vintage and other nurseries only sold as "Aus" names, before Austin sought patent protection for them in the US market. The only way for him to make money on their sales was to trademark the names they were known as. Anyone could sell as many plants of "Ausblush" as they desired, without owing Austin any money, but if the sold it as "Heritage", they owed him royalties for each plant tagged "Heritage". An "official registration name" carries no legal protections of any kind. It is simply the only name the ARS recognizes for you to be able to exhibit the rose with any hopes of winning anything. Otherwise, is means nothing.

Well it says to pick from options of container size either 1 gal pot, or 4"x4" banded pot...and then you have to pick from another option drop down menu that says to pick either tag +$5.00 or stake +$15.00 or none $0.00. And I feel like if I have to add $15 for stake, that must mean something good? But I couldn't figure out what the difference was?
