It sounds like the deputy had the personal confidence and integrity to own up to his mistake by requesting the citation be revoked. All forces need more like this guy.

There's no need to waste time wondering, this is a "good news" story.

I saw this on the news. I agree the cop handled it well.

Why was a citation issued at all with resultant court appearance when the situation was made clear immediately at the time of the stop? Bureaucracy overload and ridiculousness.

I also saw it on the news. He did not back down after pulling her over. She showed him that she did not have a right hand so therefore could not have been holding a phone.

He probably took a lot of heat when the video, from his own camera, showed quite plainly what the deal was. He could have, at that moment, apologized and let her go on her way but he did not. He issued the citation. I am happy that is has been dismissed but he was not going to let it go.

People with a missing hand often have permanent attachments on every day objects that they can just slip their stump into. Her “hand“ could be attached to the phone.

Rather than one prosthetic hand, they have several. One may not even notice the attachment and think it is actually a hand.

I don’t think this was the case here, though. I don’t know.

eta My mother-in-law had a prosthesis just for crocheting. She slipped her stump into it and the hook was mounted on the end. This was many years ago.

He doubled down when she held up her right arm. His ego was OUT OF CONTROL.

Cops look for posture. Her elbow was on the rest hand straight up? Ego out of control or embarassed so just kept moving forward. SOOO much anti-authoritarism it's shocking when you realize how many are embracing the Socialists. Good luck with that.

What is socialist about thinking you should not cite a person who has done nothing wrong in spite of your assuming they have?

I saw the entire encounter, that cop didn't like her smiling and laughing when she raised her forearm without a hand, and him being embarrassingly dead wrong he just wanted to hassle her to go to court, the judge rightly tossed it out. A-hole cop, period!

Let me get this straight.The incident happened in early February. The officer filed the citation in spite of the obvious nature of his mistake. The police didn't ask for the citation to be withdrawn until the court hearing in May? Were they hoping she'd just pay the fine rather than go through the hassle of fighting it? I don't find anything admirable about his refusal to rectify his error for 3 months.

It’s possible she had some kind of adaptive equipment that allowed her to hold it in her right hand. If she can only hold it in her laft hand, how would she use her stump to use any of the functions on the phone?

By laying the phone on a table or other flat surface maybe?

Some cops are just a-holes. I once got a ticket for turning right at a red light from a dedicated right-turn lane that had a sign indicating I could proceed without stopping. I explained this to the officer, but he disagreed and issued the ticket anyway. I could either pay the fine or challenge it in court, so I chose to go to court.

On my court date, I brought a photo of the intersection showing the sign and presented it to the DA. After looking at it, the DA immediately dismissed the ticket before I even had to appear before the judge.

Despite that experience, most law enforcement officers I’ve encountered have been helpful, professional, and friendly. They generally do their jobs well.

I ageee, some people/cops/servers/repair people/neighbors/strangers and more can be a-holes. It does not mean they can’t be polite and take ownership of a mistake they might have made.

I have also been pulled over for something sort of benign. Once I explained, the young, obviously fairly new on the job cop, left me with no ticket. Here is what happened. My DD lives in an old but active neighborhood that has multiple exit points to get back to a main road. I usually take the same route that leads me to a stop sign at an intersection where there is a school a block to the right. School was still in session. There was no other traffic around left, right, left or straight ahead. I can either go straight which intersects with a road that can be very busy depending on time of day, or turn left and get to a traffic light that makes it easier. I stopped, contemplated a few seconds which way I should go and turned left. He stopped me for not using a turn signal. I am usually the person who uses a turn signal almost 100% of the time. When I told him I changed my mind about which way to go, he nodded and said the usual ’be careful and use your signal next time’ and have a good day. I had not even seen his car when I pulled up to the stop sign, so still can’t figure out where he was positioned that he saw this unless it was in someone’s driveway behind me.

I know the feeling. They can sometimes come out of nowhere. The last time I was pulled over was for making a left turn from the right turn lane. It was pouring rain and I thought there were two left turn lanes. The cop began explaining then just said, ”I won’t give you a ticket in this rain…just be more aware.” DH got a ticket not long ago for rolling through a stop sign. He’s definitely stopped doing that! Now we notice how most people do it all the time.

I’m stumped why the ticket but you gotta hand it to her, she knew she had a right to contest it.
