What to do with drywall gouges from flooring contractor

We have hired a highly recommended and very expensive flooring contractor. Part of the job was for his crew to remove old floors. During the removal they had gouged some of the walls (mostly unde4 the baseboard line but some above) as well as chipped several tiles on the bathtub. I have a few questions
1. They are not reinstalling the baseboards so do the holes under the baseboards need to be repaired?
2. Who is responsible for repair for holes over the baseboards? (Nothing in the contract about this)
3. Is it within my right to make them replace the tile on the tub?

Some of the damaged spots. There are a lot like this.

Don't just call the references, go *look* at what they did. And I prefer to see jobs for each of the past five years... that pretty much eliminates the fly-by-night and just-passing-through guys. Dry wallers do seem to march to their own drum... even without needle tracks or glassy eyes. But the good ones are proud of doing a good job, so beware of any that don't/won't show off their work. Remember that if you hire a firm, you may not ever know *who* did what part of the firm's past jobs. In that case, you are dependent on the over-all quality of work considered acceptable by the firm (look-see for yourself), and that the firm has a good track record for the past and hopefully is well enough established to continue working in the future. Hanging wall is hard work, tedious and very detail-oriented, but it's not something that requires genius or unusual talent. If you see wavy walls, sloppy corners, messy joins, or repairs for bad cuts around windows/doors/outlets, run-don't-walk away from that crew... those just aren't acceptable results.

it sounds like he screwed up. I bet if you got a refinisher in they would reccomend sanding everything down again, cleaning properly so you do not have dust in your finish and then applying a sheen of your choice.

Thanks for everyone's input. Malhgold, my first thought was exactly yours: resand. But budge1 has a good point about the thickness of the floors. They're about 90 years old (assuming they're original to our NYC apt building). Sailormann, the spots are gone now, but the finish is very dull. The poly can says "semigloss" but the appearance is absolutely no gloss. Maybe contractor mixed it with something to make it dry faster? (I've been researching this online a bit.) I'll talk to him tomorrow. I'm all for non-confrontation and have no plans to berate him (throw him out the window, maybe, but not berate him ;-)). He's been consistently untruthful with me so I'm not optimistic about figuring out what's wrong.

Thank you everyone. I'll make a general reply to everyone. The damaged areas have all been drywalled, taped, textured and primed, but I'm still struggling with paint colors in that area so we've been painting bedrooms instead. (whole house reno.). Basically, all the drywall was done and over. Some of the damaged areas were on walls with a flat texture (i.e. no texture) and some on walls with a sprayed orange peel. I wouldn't feel comfortable patching either kinds of texture myself. If you patch an orange peel area, how do you get the texture back on the flat patch you just did? Our painting company is called Breezy DH, Inc. We're DIYing where we can, and wall and ceiling paint is certainly doable. No painters fixing holes. :( We did decide to have our trim and doors professionally caulked, sanded, and sprayed as it would take DH many months to do that painstaking, detailed work with his schedule. I am the GC so it does fall to me to take care of this. I finally heard back from the flooring company. My rep will be stopping by in the morning to take a look at the walls. He did give me some slight bs about damage below the trim, but agreed that there shouldn't be damage above. Accidents happen, but I know they were moving very fast and didn't seem that careful when I watched them several times during the first two days. I will not have the floor installers do the repairs. Didn't fall off the turnip truck yesterday. :)

Some yes others are above baseboards and the bathroom will not be covered either

It looks like damage that would be unavoidable when removing flooring and trim. Get a baseboard that will cover the damage. The bathroom tile can be covered with some quarter round or maybe patched with some type of compound. I personally wouldn't make a fuss over this.

No you don't need to repair wall before new baseboards are installed.

The walls don’t look too bad, should be an easy fix. You can approach the flooring company about it but I imagine some of these type of damages are difficult to avoid but who knows, they might agree to fix it to have a happy client. I think the tile could be more problematic. Even if you would have the damaged ones replaced, do you have extra tiles?

Some damage comes from just removing the baseboard itself, and some from flooring. Its unavoidable, most of the time. Your damage looks very minor, and mostly is easy diy fix.

Usually highly recommended and very expensive contractors have clauses in the contract to cover themselves indicating something like this: "due to limited demolition work, contractor is not responsible for any adjoining surfaces".

They should have also warned you that minor damage to the adjoining surface could happen and it should be expected.

Drywall is a minor issue to fix and it will be covered with trim as someone mentioned before.

As trim goes, if the contractor does only tile work, they don't usually do trim work... unless it's a remodeling company they would have someone to handle finish carpentry work.

Most handymen can put the trim back, also not a big deal.

Unavoidable and to be expected. And some of the 'damage' you are bothered about was probably existing and hidden behind the trim--(Photo #2, for instance).

I would be happy because the damage is minimal; I would have expected worse.

Hire a drywall guy and a finish carpenter. That’s just part of the overall expense of doing the job, and you as the job GC should be aware of that. Any standard GC would be, and would have already scheduled the followup trades.
