What to do with drywall gouges from flooring contractor

We have hired a highly recommended and very expensive flooring contractor. Part of the job was for his crew to remove old floors. During the removal they had gouged some of the walls (mostly unde4 the baseboard line but some above) as well as chipped several tiles on the bathtub. I have a few questions
1. They are not reinstalling the baseboards so do the holes under the baseboards need to be repaired?
2. Who is responsible for repair for holes over the baseboards? (Nothing in the contract about this)
3. Is it within my right to make them replace the tile on the tub?

Lesson #1 is that anyone who solicits business at a box store isn't likely to be of the best quality. If he were, he'd be shopping at a trade supply house. Lesson #2 is NEVER hire any contractor without verifying references, checking insurance and licenses, and viewing past work that he's done. Lesson #3 If the contractor doesn't mention permits and inspections on any job bigger than changing a light bulb, then you don't want him in your home. Less #4 is to structure the payout schedule according to completion milestones. 10-20% to start the job, 50% at halfway, 80-90% when the job is 95% done, and the remaining 10-20% holdback 30 days after completion when any punch list items are taken care of. Lesson #5 The written word is gold. Verbal contracts are hard to enforce because each person can interpret it differently. Get it in writing! And that means everything! You want the materials to be used, the process that they should be installed with, the error tolerances that are acceptable, the timeline of the project, the payout schedule of the project, the process for written)change orders as well as what will happen if either of you breaches the contract. You might add your name and story to the police report, but don't expect to ever recoup anything from it or for the guy to actually go to jail. You're better off getting quotes from several licensed contractors to just fix the mess and suck it up and pay them to do it. Education is expensive, but not if you actually have learned from your mistake here. It will pay off in the long run.

Thanks for everyone's input. Malhgold, my first thought was exactly yours: resand. But budge1 has a good point about the thickness of the floors. They're about 90 years old (assuming they're original to our NYC apt building). Sailormann, the spots are gone now, but the finish is very dull. The poly can says "semigloss" but the appearance is absolutely no gloss. Maybe contractor mixed it with something to make it dry faster? (I've been researching this online a bit.) I'll talk to him tomorrow. I'm all for non-confrontation and have no plans to berate him (throw him out the window, maybe, but not berate him ;-)). He's been consistently untruthful with me so I'm not optimistic about figuring out what's wrong.

There are 2 types of smooth finish in my midwestern market. "Ugly" and "Awesome". Ugly is about the same labor as orange peel & knock down (also called executive). Awesome smooth walls require leveling of drywall, complete skimcoat, and extensive attention to detail. Ugly is ugly because it ends up being really wavy and inconsistent. Especially true of old homes with previously plastered walls. The old lumber varied in thickness considerably and it was the job of the plasterer to level out these inconsistencies when he applied the mud. Drywall is the same thickness throughout and will not even out these differences. Smooth compounds this because it hides nothing. I've had some success with customers who get sticker shocked at smooth by switching to a very light orange peel. Not as awesome as smooth, but better than an orange peel. Still need to level the studs prior to installing the drywall though. Knockdown is the favorite of any drywaller due to the amount it hides. I've seen some pretty gnarly seam taping almost disappear when the k/d was applied. So in short, if you want smooth, be fine with paying extra for it or you might end up with ugly. Best of luck. Water will soften the compound and a stiff plastic scrub brush will get it out of the texture. You probably need more water than you think (and the water needs to be clean for every use), and I'd use a wet/dry (shop) vacuum to remove the slurry, and not a mop, at least on the first pass. I've used this technique on a few small spots -- cannot imagine doing 2000 sq. ft.

Some yes others are above baseboards and the bathroom will not be covered either

It looks like damage that would be unavoidable when removing flooring and trim. Get a baseboard that will cover the damage. The bathroom tile can be covered with some quarter round or maybe patched with some type of compound. I personally wouldn't make a fuss over this.

No you don't need to repair wall before new baseboards are installed.

The walls don’t look too bad, should be an easy fix. You can approach the flooring company about it but I imagine some of these type of damages are difficult to avoid but who knows, they might agree to fix it to have a happy client. I think the tile could be more problematic. Even if you would have the damaged ones replaced, do you have extra tiles?

Some damage comes from just removing the baseboard itself, and some from flooring. Its unavoidable, most of the time. Your damage looks very minor, and mostly is easy diy fix.

Usually highly recommended and very expensive contractors have clauses in the contract to cover themselves indicating something like this: "due to limited demolition work, contractor is not responsible for any adjoining surfaces".

They should have also warned you that minor damage to the adjoining surface could happen and it should be expected.

Drywall is a minor issue to fix and it will be covered with trim as someone mentioned before.

As trim goes, if the contractor does only tile work, they don't usually do trim work... unless it's a remodeling company they would have someone to handle finish carpentry work.

Most handymen can put the trim back, also not a big deal.

Unavoidable and to be expected. And some of the 'damage' you are bothered about was probably existing and hidden behind the trim--(Photo #2, for instance).

I would be happy because the damage is minimal; I would have expected worse.

Hire a drywall guy and a finish carpenter. That’s just part of the overall expense of doing the job, and you as the job GC should be aware of that. Any standard GC would be, and would have already scheduled the followup trades.
