If a Japanese maple, the roots are not invasive with regards to foundations or intact underground plumbing. As to if that is an appropriate distance away from the house and its potential root spread, we have no way of knowing unless you tell us the specific cultivar of maple and where you might be located. They grow differently in different areas of the country and they range in size from 2-3' to 30'. ETA: Just noticed this was a 5 y.o. post :-) Was getting ready to delete my comment but thought I'd leave in case anyone else was wondering the same thing!

Japanese maples do not produce large or aggressively spreading root systems. One of their great advantages, as that means these small trees can be planted in very close proximity to structures or paved surfaces without concern and one encounters this frequently with JM's. If the tree has already been there 40 years, any damage the tree might have created would already be present as the root system will be at a full, mature spread. Attempting to install root barriers now will only serve to severely damage the root system and would very likely cause the demise of the tree. If an inspection of the property DOES indicate damage to the slab - which I highly doubt - then your best bet is to remove the tree completely.

@ken_adrian Adrian MI cold Z5 thanks for your reply. I agree with you on the wonky part. I also noticed the dry and peeling bark on the trunk. We have animals like squirrels,rabbit, marmot and chipmunk in the backyard. Could they be possibly the reason? Is there anything i can do to stop the wonkiness and the peeling bark? it is my first time to plant a maple, maybe you are right about the leaves. I expected them to grow thick and red. I will keep observation. Looking forward to your reply.thanks
