Only you can decide what you're willing to deal with here. I will say that if you decide to go before the contractor's board, they will expect that you've tried all avenues to correct the problem with the contactor FIRST before resorting to them. And they will look at the specs of the job overall, and what would have been a reasonable result to have been expected given the site conditions and the contract language. If you are the one that set the specs of the job and then got bids for it based on those specs, then you cannot hold a contractor at fault for following the specs that you set forth. Was the difficulty of installing large format tile discussed with you at all by anyone before you chose it? Even with perfect slab prep, you will have some lippage with large format tile. It bows in the middle. It's the nature of the tile to have lippage when installed in any other pattern than stacked where the bows in the middle align. And that's why manufacturers only recommend a 1/3 offset pattern. It minimizes any lippage issue. Is that the pattern you chose for the tile? Or is it a "random" pattern. That will create more lippage that wouldn't be the contractor's issue. It's the nature of the tile coming in to play. And it would be installed contrary to the manufacturer's recommendations, so it wouldn't be supported as an actionable item. Any tile floor can only be as flat as the substrate it's installed on. What type of diagnostics did you or the contractor do to determine what type of prep the slab would need? Would you have been willing to pay an additional $500-1K to ensure that you had a problem free install? That would include grinding down high spots, and filling low spots until the floor was flat enough to support large format tile. Was the flatness of the slab discussed at all? If you would have been willing to pay for better prep, then the contractor should have done that better prep at the additional cost. A true tile pro would have at least brought it to your attention and had you sign off on it if you refused to do so. If the condition of the slab was brought to your attention, then you really don't have a lot of recourse for the issues that you are seeing. As far as the cleanliness of the job site, contractors usually stipulate "broom clean" which doesn't mean move in ready. It means the majority of trash is gathered up and the place is swept. It doesn't mean mopped and scrubbed. You should always plan on cleaning a space post renovation, or hiring a cleaning service to address the job. Renovation produces lots of dust and dirt and it gets everywhere. It's not your contractor's job to deal with that unless it's written into the contract that he will hire the cleaning service upon job completion. That would be a higher bid for the job, of course. It sounds as though your tile job simply needs a good initial scrubdown.

Unless you can prove that the subfloor was not perfectly done (sounds like they got it as close to flat as possible) then we have to look at the TILE. Tiles this large are almost always warped. The LEVEL of warping is now the question. As Sophie points out, you need to find out HOW warped is "warped". The easiest way to do so is to put two tiles "face to face" (pretty side to pretty side) and then "back to back" (ugly side to ugly side) and take PICTURES (if you can get a ruler or a measuring tape in the pic that would be even BETTER). Post those pics. And now the crucial part: who chose the tile (s/he who picked them is responsible for them)? Who gave instructions as to installation pattern (1/3 off-set, 1/5 off-set, 1/2 off-set, etc)? Who was on site to receive the tiles and signed off on them? Who gave the 1/8" grout line as the required amount? The person (or persons) who made all those decisions will have to answer to them. For this reason, many of the "outstanding" tile setters will insist on choosing their own tiles (or Kitchen Designers will insist on using their own suppliers) so that this does NOT happen. And Joseph is correct. The "worst offenders" are worth dealing with if the entire floor has lippage issues like this. The fix is often worse than the disease. As Sophie is fond of saying, "Lipstick on a pig." This is either a "live with it" or it is a complete redo.

Can the lippage be fixed? Not without demolition and re-do of the job. If you haven't paid in full yet, you may be able to negotiate a discount. Lippage is more of a problem with large format tiles because they are harder to set. What looks like a center offset isn't helping, either, because the tiles themselves can dip down in the middle, so when the ends of the offset tile are set in the middle, the differing levels are accentuated. It takes a very level floor and a lot of technical skill to avoid lippage with the larger tiles. The floor should have been leveled using a self-leveling compound prior to installation if it varied by more than 1/8" over an 8 to 10 foot distance. The grout does look low in your photo. I don't know what kind of adhesion issues you might have trying to build that up. Perhaps someone with more knowledge could advise you as to your contractual or legal options. If you get it redone, I'd go with a different contractor.

I am attaching 2 pictures from slightly different angles. From what I have read online, it looks like it should have been 1/3 offset instead of 1/2 offset for 12" x 24" tiles (I never specified a pattern). The floor is 173" x 83". The subfloor is wood (second story bathroom). Hardie backer board was screwed into the wood. I wasn't given a breakdown of price for different things. The quote was $6,000 for demo and tiling of the shower and floor (labor only). I do not see any standards referenced in the contract. The flooring before was a different tile. I attached a picture I could find of it. In Texas, there is an Implied Warranty of Good Worksmanship, defined below: Implied Warranty of Good Workmanship: The Implied Warranty of Good Workmanship provides a warranty to the owner that the construction, repair or modification of existing property will be performed in a “good and workmanlike manner.” “Good and workmanlike” means the quality of work must be equal to the work performed by someone “who has the knowledge, training, or experience necessary for the successful practice of a trade or occupation” as judged by someone “capable of judging such work.” I am currently searching whether "good and workmanlike manner" means following national standards (ANSI). From what I have seen, "workmanlike" means that it will follow the standards.
