Is this Cause For Concern?

I have my own opinion on this but I am not a construction specialist or a builder. So I come to everyone here for opinions.


We have been in our new construction home for two years and the build and post build was rife with numerous issues. It took them 15 months to build the home prior to us moving in two years ago so it’s been a really long road.


When it came to our one year warranty work the builder did 3 small items out of a list of over 30. Some of these items were still on the list from our initial walk through. We had given up hope and with some other owners in the neighborhood have been gathering information to contact an attorney.


Out of the blue someone from the builder contacted us and asked if our items had ever been taken care of. We responded no. This came on the heels of the LATEST construction manager being fired. The first item on our list was our hood. It had split and pulled off the wall. They have refused to replace it and in fact had the cabinet company send us an estimate for $2683. If we wanted it replaced. another issue is our quartz counter top had split at the seam and shifted. One portion of the counter dropping lower than the other. The counter top company came in and fixed it today by shimming under the counter. It looks good . But they told me that they had to shim in 1/8 of an inch to bring the counter level. This counter was level when we closed. Here is the thing one of our items is our flooring. Manufacturer hardwood. It is now hollow in areas. Has risen in others where we have actually chipped one along the edge because it was sticking up. The only way I can describe the feel of the flooring underfoot is it feels swollen in some areas and sunken in others. We are on a stem well slab foundation. One area where it feels lower is right where the counter top split.


The counter top installer mentioned 1/8” is a lot for “settling” which is what the builder claims caused the hood to split and pull off the wall.


here is the last bit. We found out the last construction manager was fired because an inspector caught on that he was shorting the foundations. I don’t know what this means. Shorting? Now I am very concerned Ed that the reason all this is happening is due to foundation issues.
