Crooked wall in entry way of new home, haven't closed yet

We contracted to have a home built, and on the final walkthrough noticed a wall between two doors right off the entry way that is obviously crooked. It's not a starter home, but not a custom build either. The general manager and real estate agent both agreed and acknowledged it's obviously crooked, but they didn't sound like the developer may do anything about it. What is a reasonable remedy? I've notified them we need to reach a solution before closing. There are two interior doors between the area and there would be a lot involved to fix it. On the other hand, for the rest of the time we own the house this will bother us and it's in the entry area. Anyone have any ideas or creative solutions?

What did your RE lawyer say? You could get an estimate for repair and have that amount withheld at closing pending resolution.

In Canada you would just note it on the PDI and Tarion would make sure it gets fixed via new home warranty insurance.

Here's what I did: I always have extra tomato plants even after I give them away to friends and relatives. I used to just drop them off at the local community garden with a sign FREE PLANTS. A few years ago, I started labeling all my plants with plant info, my hobby farmÂs name and email address on each plant. Two years ago, I took all my spare plants to the local community garden and posted a sign FREE on them. The difference is this time I stayed with the plants for a few hours and handed the plants out along with information. Most of what I raise are heirlooms so many of the community gardeners were unfamiliar with them. I received several emails over the course of that season from those gardeners, many were thank you and some were with questions. I saved every one of those email addresses. Then 15th of March of last year, I sent out emails to all those gardeners, plus my entire address book offering tomato plants for sale in time for spring planting which around here is Memorial Day plus or minus a week. I told folks what I was raising and that I would be selling them this year. I gave folks the option of reserving plants or taking their luck first come, first serve on the 2 sale days I would be having at my house. I got a few checks and a lot of emails. Then as the "Sale Days" approached, I posted the dates on Craigs List. I potted all the plants up to 4" pots about 2-3 weeks before the sale, hardened them off and charged $4 each for them, 4 for $15, 7 for $25. The pots were beautiful 4" pots I got 10 for $1 from Christmas Tree Shops. I sold every plant and added to my database with new email addresses from the Guest Book I had out at the sale.

I have them in my new home and feel they add a European influence. Mine are not cased, and don't think the look is particularly contemporary, but maybe that's because my style of decorating isn't. I've thought of painting the interior of the arches as well as an 8" border around the arches to define their shape. I would also add large shell plaster castings to the center of each arch. Paint color would be the same color as the trim(warm tan, 3 shades darker than walls)or possibly black since i've used a lot of black in other areas of the house. I've been mulling this idea around in my head since I bought the house, just need to make the decision to do it! ;o)

This is where I am at, DH seeÂs us remodeling kitchen in three or more years and I see us remodeling our kitchen in the next year or earlier. So, Right now I am more in the process of elimination as far as cabinet brands go. Many earlier brands have been eliminated due to size issues as in I want and need deeper and taller wall cabinets and prefer little to no fillers. Also, cost has been a big factor. I have a basic idea of layout but need help in changing the nook area and windows. Some appliances will be reused but we will replace refrigerator with the kichenaid 42" built-in French door paneled and replace the microwave with the adventium. I have the countertop narrowed down to three or four and know exactly what I want for the backsplash, still unsure of wall splash behind stove though. The kitchen sink has been narrowed down to two choices and cab hardware to three. I know what I want for lighting but havenÂt found exactly the right one, I will know it when I see it. Still tossing around the idea of wood range hood verses stainless. The doors of my dreams are simple $$$applied moulding but with most likely end up with nice raised panel for style of home. Husband thinks I spend way too much time thinking of and planning for the kitchen.

Even with the coat closet right there, I'd still put in a hall tree with a bench and shoe stowage there. It's generally rude for a guest to be opening closed doors in your house without your permission, so it's a good idea to provide them with a hall tree or coat rack so they don't have to ask you where to hang their coat. Also, if you have a no-shoes house, do you want your guests (or family members) to be going into the living room with their shoes on just so they can have a place to sit to take their shoes off? That's not intuitive. If you have your hall tree bench and shoe stowage right there at the entrance, it's a very clear signal that you need to take your shoes off, and any polite learned houseguest will do so without bidding. Much more effective than a condescending little sign or you standing around to remind them to take their shoes off.

Get a quote for the repair. Have that amount held back in escrow and only paid out to the builder once repairs have been made. He who has the gold makes the rules and you need to hold on to some of that gold to keep your leverage with the builder.

You can also stand your ground and refuse to close until they have fixed the problem.

Who owns the land, you or the builder?

I can't tell from your post whether you are being represented by a Realtor. If so, then you should be looking to them to negotiate a reasonable solution.

Threatening to not close is virtually an anticipated breach of contract. Don't do that!! It is MUCH better to bring the other party to the table to negotiate. You may be able to have these active "negotiations" delay the closing, but beware of unilaterally failing to close. Talk to your lawyer.

There is probably a lot in the house that is crooked. New home builds I've been in are filled with them. Some are bigger than others of course.

I found one in a new build I had done the first day after we closed and I figured it would bug me forever. Nope, I forgot about it and it's a non issue now. It's funny how things can feel like a big problem at the time but really aren't. You go into it expecting a new build to be "perfect"- but then you realize perfect is an illusion.

But I agree this needs pictures. It might be fine, it might be a oh hell no.

I designed a house where the builder installed the windows and then noticed the extension jams were built wrong (crooked) by the window company; I did not notice it. The builder (on his own) contacted the window company and worked out the solution, All the windows (79 if my memory serves me right) were removed, repaired or replaced, and reinstalled at the expense of the window company (material and labor). It is wonderful to work with a builder that knows the difference between right and wrong.

We lived with a caddywompus wall for nearly 20 years....so glad it is gone! It really bothered me. The sill plate was to the left of the marked line and the top plate was to the right. Had to live with it because we fired the builder over even bigger issues, never noticed this until everything was finished.
