I hurt the city's tree
Comments (20)Very interesting story. I don't know how high the roots were but what the city does here is wiggle the sidewalk around the trees. That might have worked, but on the whole that tree is flat out too big. I too immediately thought of the media when I read your predicament, and in fact this is also an opportunity to mention my other policy for circumventing bureaucracies: complain to the top, and let the top delegate down. It's way easier, and causes far fewer bad feelings, than starting at the bottom and working your way up. The bureaucracy is motivated to please the top, but not to please the client, so you have to make pleasing the top dovetail with helping you. If you start at the bottom and work up, you come to each successive level as a problem with negative connotations. If you start at the top, you come to the level that can help you as an opportunity to impress the boss. For instance, I had a problem with stupid parking regulations on a local university campus, so I wrote to the university president. Problem solved, with good feelings all around. In your place I would have used the media in the first place when the bureaucrats did not come through for you. Now, you embody the "if you can't be a shining example, be a sobering lesson" type of story, but it will still motivate the political structure to respond better to the next bumpy sidewalk call. And I'm sure a lot of people in wheelchairs, or with strollers and walkers, will chime in once your voice is heard. So absolutely, call a reporter. Comments (14)The permit for the fence is a separate issue from the easement (if any easement exists). The office that approves the fence is telling you that it is OK (i.e., ok with the zoning code and basic engineering principles) to put a fence of the proposed height and type in the yard of a house in your neighborhood. They're not telling you about easements. That's a whole different office, in most cities. Zoning and easements are two different things. And it wouldn't be "the city" forcing you to take down your fence; it would be your neighbor going to court and getting a court order that says you have to take it down. So, short answer, IF there is an easement, and IF the easement does indeed prevent you from putting a fence there (there are infinite different kinds of easements), then yes, your neighbor could go to court and win... IF they were willing to go to the trouble of filing suit. That's a lot of ifs. You can answer the first two questions yourself by taking a look at your title insurance policy, or by going to the property office (whatever it's called in your area) to ask for the records of your property, which should show an easement if there is one, and should state what kind of easement it is. If there's no easement, or if it's not the right kind of easement to prevent building a fence, then your neighbor couldn't force you to take it down. If there is no easement, don't worry. Comments (10)New windows can help with noise if they are chosen with that in mind. Plants can provide visual buffer but do not buffer sound, even with density. I hear traffic despite being more than a half mile through dense woodland in either direction from highways. The only thing that will buffer road sound is something solid like a wall or solid fence, neither of which would look particularly appropriate in your setting. If you want the visual barrier to be year round it will need to be either an untrimmed fountain shaped and densely twiggy plant like forsythia or ninebark, or else evergreens like Rhododendrons or shrub sized conifers. Depending on the look you want, you can use a mix of several types of plants for a less formal look, or all the same kind for a more formal look. Look at large shrubs as opposed to trees because of the power lines. Good on you for thinking of that issue as many folks don’t. I don’t know what you mean by a boulder garden, but generally in the eastern half of the US, rocks are difficult to keep weeded. They tend to do better in areas that are more arid. Considering that grass appears to grow well in your area, it isn’t a choice I would be likely to make. Can you provide a photo of what you were considering? While growing zone is one helpful piece of info in making plant suggestions, eneral location is as well (nearest big city and state). For instance, there are parts of MA, WA, VA and NM that are in zone 7, but due to different climate, moisture, and soils, different plants will grow well.
