Comments (60)Ty to the almost everyone on here for your support, I really appreciate it so much and have learned so much from this whole experience. Last update, we have rescinded the contract, the seller has decided not to fix the wiring, and after meeting with her LA and my REA she will not budge. She has an emotional attachment with the home we were now told, we dont think she really wants to sell it. Her own LA told her she was being silly, she wouldnt even let the contractors in to get a bid on the electric..so we have moved on and to be honest I am extremely happy at this point. It has gotten to be too much for me. To try to answer some questions, the gut rehab across the street is still in the running with us, only problem is we think the rear yard is too small for the kids the way it is fenced and the placement of the garage.That was the only reason we didnt offer on it, the garage is smack in the middle of the back yard!! As far as my DH, Yes I did defer to him when it came time to write the offer, he is the sole breadwinner here and I knew how much he wanted the house,we both wanted the same result, I just let him take the lead on this at the time. We are new to the whole homebuying thing,so it was a bit stressful at the time. Diane- sigh, Im sorry you feel the way you do about me, my thread is now done so I guess you can go find someone else to "pick on". I never asked for sympathy nor did I feel I was a victim, I was looking for advice which is what this forum is here for. Please think about how you post to people, I am not new here, just new to posting. If I were a first time poster you would have already run me off. Thank you all, we will be looking at new listings in the next few weeks and hopefully will have good news to share soon!! Comments (8)JMO here, as one who recently sold a house: The question is whether you KNOW of any defects. You just said that you do not know if the location of the box is a defect. So take the simple route and tell the truth, which is that no, you do not know of any defects. The buyer's home inspection may or may not reveal the location to be a problem...you can deal with that then. You shouldn't have to do any research to answer questions on the disclosure form You're simply revealing your current (for sure) knowledge of the house...not whether you think maybe something is possibly wrong....See MoreBuyers may be backing out...
Comments (24)The way the inspection report was done for our house was that the inspector wrote the buyer a letter. There was a summery of the house (age, type, location) then he listed a few things, the flue on the new furnace, concrete blocks in the crawl, kitchen sink not being the right trap, electric outlet not ground right. At the end it said a detailed inspection report would follow to the buyer. The buyer sent a letter to my agent saying they wanted numbers such & such to be considered for repair. There really wasn't a lot on our report, I don't doubt our buyer knew they were getting a decent house. Thankfully we only lost two weeks but now we're a three-week old listing vs. a brand-new listing. I also worry we now appear "tainted" that we had a deal fall through. It's frustrating since we feel we've been so honest about the roof and very fair in our pricing. I don't think I'd worry about being "tainted". It's a weird market, people are backing out all of the time. Look at the news, real estate is not looking good. Buyers get scared. You're very lucky to have gotten an offer so quick. We were on for 9 months, then a 60 day close which I would never recommend. If you do get a contract, insist on a 30 day close if you can. I wrote a polite email to the buyer directly to ask if the roof was really the only reason he had decided not to go forward with the contract. I probably should not have, and I didn't exactly expect a response, but couldn't help myself from asking without the game of telephone through agents. He never responded. I do wonder how this ended so badly. It seemed hostile when he told our agent he wouldn't share his inspection report because he himself had paid for it, yet said he was going to make a lower offer based on his report. How could we even consider to accept that without privy to the inspection report? Now my husband and I are worried are there other things wrong with the house. Our realtor was at the inspection and he keeps reassuring us there really isn't, that these buyers are using a roof they knew about to get out of the deal. Who knows why buyers back out? We had one back out during attorney review, never got to the inspection stage. FWIW, the buyer doesn't have to share the report with you, and if they did, you might have to fix what you know about or disclose it. Could be anything from the school system to a registered sex offender that you don't know about. It could also be that buying a house was too stressful for them as a couple. Maybe they work pretty far from the house, with gas going up they changed their minds. Comments (89)Even our lawyer IS concerned about their death and infirmity contingency. In all his years as an estate and realty lawyer, he said he has NEVER seen that kind of contingency. Especially their infirmity contingency. He wanted it defined. It was defined by their lawyer mostly as a loss of the ability to make a decision. So NO, I am not heartless when I pray for them to live and be healthy up until our closing. I only wish them to last until I sell them my home.... I wish to close without having to worry about putting my home back on the market once again!! I don't think I could bear going back on the market again if anything happened to this sale. These people may be paying cash for the sale of our home, but they only put down 1k as a good faith gesture to purchase. Paying cash for full amount.. with only 1K in cash as a deposit could mean they could walk at any time until closing! They would not be out much if they did so. However, I doubt that they will do that, but you never know. Still I will not really RELAX until we officially close a month from now. Rental agreement is now in place, they didn't budge much on their rental price but we don't want to rock the sale of our house at this point. They only made the offer to buy because they knew we could rent the house back to them. So they will be making a nice profit on us from renting it back to us for 3 months. And we are alright with that... considering we actually were better about giving them a good price for our home.. we didn't dicker as much as we could have. In the meantime, our house inspection turned up with no major problems (which I assumed would happen- but who knows if there is anything lurking beneath the surface) although we are still being tested for radon... which who knows what that will be??? Never had one in all the almost 30 years we have been here. Hopefully, we will pass that. The building inspector will be picking up the containers on Monday at noon and said he will be able to get the results before the time expires for us to go under full contract....See Morehomechef59
