On the construction materials I would get rid of the cement board or any wood stuff. Leave the tiles & flooring pieces (that could be used) and put a note saying these are extras that could be used to repair the existing if they would damage them in the future. The reason for the note is that some people don't think about the reason for them, but relizing they could be useful would remove the trash label they had in their mind before. The paint I would either ask first or get rid of. I didn't want any of the previous owners paint as I wanted to re-paint so I was left with the task of discarding the paint. The curtains should be yours, rods are not. The arbor and picnic table I would definetly ask as they could assume that those are staying. The plants and birdbath are yours, but doesn't hurt to ask. Lastly I'm guessing your realtor is making a very good commission off your house so I would most likely ask why he isn't willing to do his job for that.

What a hoot! I've dated the 40-ish, athletic, friendship first, fun, good-looking, honest guy! He said I was too independent & hard to get along with... But I have one to add: Independent: If he has a job, he'll quit as soon as you become a couple.

What you have can't be fixed or patched, you need to tear out all the damaged sub-floor, find out what was (or is still) causing the water damage, put down new subfloor and tile. At this point you also need to look at the age and condition of the toilet, tub, shower and other fixtures in the bathroom ... it might make sense to gut the whole thing since you are going to rip up the floor.
