If this happened in the USA, wouldn't the Felony Murder Rule come into play? If the guy hadn't raped the girl (a crime), she wouldn't have gotten pregnant and, therefore, wouldn't have died in childbirth. He is responsible for what happened to her. But, as Elmer said, it all depends on the laws in Paraguay.

If this happened in the U.S.,that child would most likely not have been denied medical intervention that would have saved her life.

I agree with Lindsey and Elmer. Despite our personal feelings, asking whether he should be tried for a specific crime has to be answered by looking at the nations laws.

The article seems to be attempting to blame the pro-life laws in place that "forced" the 14yr. old to carry the pregnancy to term. It wants us to believe it was the laws fault, not the rapists. Nothing is mentioned concerning the mother's choices. Using current US PC thinking we need to know HER wants to decide. Do we see how INSANE abortion laws are?

I think he is guilty of several charges, assault, rape and manslaughter on two counts. If I were in charge, I would throw the book at him. I hope the law in Paraguay reads the same way!

I don't know how prisons are in Paraguay but here if you do something to a child they'll take care of you in prison. And why after her passing away during childbirth do they now have him in custody? Why not after he raped her?

I'm not reading the link or thinking about what their law says, this is my opinion only: Any rape should be 'bad enough' for a significant prison sentence. Any deliberate harm to a child should warrant a significant prison sentence. Rape of a child should = life in prison, at minimum. The subsequent sadness, the too-young mother and her child both dying, doesn't need to be a factor in the rapist's penalty -- he should be permanently out of society one way or another already.

But for the fact he rape her, she wouldn't have died. Right? So he's the cause of the murder. So he should be tried for murder. I don't believe in the death penalty for moralistic reasons, therefore, life imprisonment.

The baby boy didn't die. So it would "only" be one count.

so now grieving parents have to raise the child?

I think child rape deserves a death sentence, but that's just my opinion.

He raped her and she died because of the resulting pregnancy, so I believe he should face a murder charge. However, a government that would force a 14 year old rape victim to carry out a pregnancy is just as guilty. Shame on them.

One law that would be good to change is their age of consent, which is 14. What that means is that if she had consented and subsequently died in childbirth, no crime would have been committed(in Paraguay).
