Confused tree or root issues?

Its beyond me why nurseries don't prune something like this earlier and worse yet ship it to customers and state nothing is wrong. It was the nail in the coffin to stop going mail order except for two places.

Back to the question. I pruned out the weaker of the two co-doms last fall.
I've since had the other staked to the lower main trunk to straighten it.

To my surprise I took the stake off yesterday and the plant leaned even further at 45 degrees off the trunk.

I've done in this past to train new leader and after 1 year all is good. Would you give it another year? Its tightly rooted but was overgrown in a rootmaker. Apparently nurseries use the rootmaker pots as a license to not up-pot. It almost impossible to get through the fibrous roots to reveal any root stock girdling or circling. With that said I only loosened the outer roots, likely cut a few encircling roots.
