Leaking pipe under toilet and impact to tile floor

new home construction, dealing with a "leaking toilet" for 3+ months. They came and tightened the toilet down, then came and replaced the wax ring. The grout has remained an issue....being told for the last 2 months to give it time for the grout to dry out. Told us to get Damp Rid and sit in the area. (Can't make this stuff up). Finally forced my husband to stop using it, over 9 days later, no change to the grout. Plumbers came back out, removed the toilet (it's replacement was next step) and he found the pipe was cracked. So we have had sewage leaking out each time it was flushed. And now the toilet is sitting in the garage while we wait for the builder to follow up. Plumber won't fix pipe till we address the tile. He said we should rip it out and replace the area damaged by the leak. Builder solution is to just replace the grout. Ok, except it sure seems that because we have a membrane, and thin set (or whatever is used) that water has been trapped under there. Interested in feedback on the right way to get this fixed. Can't seem to google the right phrase for additional insight. Thanks
