Hello Mahalo .. I am not an expert either on Kelps and Seaweeds ... This is what Harold C. Bold Professor Emeritus of Systematic Botany at the University of Texas at Austin has to say in "The Plant Kingdom" a good book by the way : He places the "Kelps" in the Kingdom "phyta" or Kingdom plants and then into the division Phaeophyta ( Brown Algae ) the "seaweeds" I believe would fall into the Division Chlorophyta "Green Algae" ... He defines Algae as follows : "Chlorophyllous organisms having one of the following " Gametes but no specalized sex organs ( this is a charecteristic of certain unicellular Algae ) unicellular sex organs multicelluar sex organs in which every cell forms a gamete. Now here is the confusing part ... those or at least quite a few Algae that can be by item #1 of the above definition have been moved somewhat recently to a new kingdom Protista. These include the divisions Pyrrophyta ( Dinoflagellates ) , Euglenophyta ( Euglena ) , Chrysophyta ( Diatoms ) . These are all unicellular .. chlorophyllous and mostly autotrophs. Kelp and Seaweed are multi cellular and have been left in the plant Kingdom. There are four other Divisions of Protista that are heterotrophs mostly... and are refered to as Protozoans. These trees are closly related to poplars, but are populus. I've included a link that tells about this tree and you can click on it's invasive tendencies. A former neighbor of mine (she had the one growing in her garage) has one. Her late husband wanted a tree so went into the timber to get one. While he was alive, yea, he cut down the suckers with the lawn mower. Trouble is, after a while, it doesn't just sucker in your yard. It comes up against your foundation, in your flower gardens, in back of your house, cracks in your driveway, on the other side of your driveway...get the picture? You spend all your time digging up the suckers. Because if you just cut them off, they sprout again. She has no family in the area, so guess what I get to do? Well as the host, you could have started it with say...25 packets if you had 5 participants. The 25 packs are mailed to the first person who, selects as many as they want and replace the same number of packs so that you still have 25 packs....and so on.... When it comes back to you, you have 25 packs of different seeds than when you started. Be sure to e-mail everyone when you decide exactly how many packs will be traveling.... That is going to be the easiest thing to do and it is probably not too late to catch up with it if you notify the first person to hold it until you can send more packs.

I don't know about Texas laws but I believe Moni may be right in saying as long as its on public land its "yours for the pickin" so to speak. Its much easier to get it out of the top of the trees the way we did it when we were kids....shoot it out with a gun....works every time..... ~Kathy~
