Why do you let them use your driveway?...I would stop that first...let them clear a driveway for themselves...It's not like you are best friends or want to become so.

And if it really bothers you...and you have a lot of land...Have your home moved away from them but still on your land. It would probably be cheaper than relocating...
Most homes right now will not bring what you paid for them...

Then I'd fence my yard between the properties..

well, i would contact your township and make a formal complaint. why do you have to share "your" driveway? put in a speed bump if it is your driveway. if it's a common driveway, nothing you can do about it - unless of course you block off your portion of the property and divert your drive to the other side of your house. if trash is piled that high, it's a hazard - call the fire company. it's also a health hazard. but i'm thinking you mean "things" and not garbage. grow some large hedges or trees or bushes to block out what annoys you. earplugs will help you with the all hours of day and night with the cars in and out. stealing your gravel and you didn't report them to the police? strange set of circumstances created in your little piece of earth.

**sigh** I used to live nextdoor to those people, I think. I would put up a gate, and tell them to get their own damned driveway. Then I'd accidentlly "drop" a bunch of roofing nails on theirs. Hedgerows are good. Fences are better.

I'm sure the right of way is official. It's probably how the owners of the property were able to sell it. I don't believe you would be able to reverse that.

Don't have a clue about anyo of it. Call the county or city, I suppose on the garbage. And keep calling. As far as the gravel goes, the only thing I can think of is to have a "curb" or partition poured, keeping the gravel where you need it. They would have to actually go scoop it out.

Earthly has some good practical advice. If it were possible, I would build my driveway elsewhere and fence/plant the property line. And moving the house is not a bad idea either.

This is a tricky situation. We have a notorious ongoing case out here at the moment. A married couple shared their driveway with a neighbor, or at least he thought they did. The dispute over the situation occupied years and many actions, especially on the neighbor's part, who was a real crank. A few months ago he had a boulder placed in their driveway when they were away. Then he lay in wait for them. When they got home and walked around surveying the boulder he emerged and shot them dead.

Property line conflicts are no joke.

Thanks for listening to my gripe!Kat is right- the right of way is a recorded legal part of my property title. I just had absolutely no idea that there were disgusting 'thins' like this living in our world. I guess I was a bit 'dumb', to put it mildly. And it is impossible to move my house- it is an earthship. I will be putting it up for sale- I just hope I don't have a problem selling it. I would warn anyone- never, nerver consider buying a house that has a right of way. An easement is even worse, unless I have it backwards! As it is, the right of way, it is still my property- they can only use it to come and go. As an easement, I guess it sort of becomes 'theirs'. I just might have to drop a few nails as I go on vacation.....

I think the speed bumps are a great idea. It's your property, and I doubt the right of way has any conditions forbidding you to do that. And, I'm wondering why not pave the driveway? They can't steal the cement. LOL

Why do you have to provide access to another's property?

Did they take the gravel from the right of way road or your driveway? If your driveway it's theft and I'd report it.
I'd also report the large amount of traffic and the speed.

That's usually a good clue to possible drug activity, in which case the police could get involved.

Driving fast on gravel just ruins a driveway, we found that out when people would zoom up and down ours. It throws the gravel out and leaves depressions that make puddles and they just grow and grow. We get our driveway graded and graveled every couple of years. Because of the hill next to it, paving it isn't really an option, plus it's too long to be affordable.

If they are unreasonable people, there isn't much you can do about it. Good luck selling your place. I wouldn't want to be in your shoes.

Speed bumps would be a good idea, but I don't think they would work on a gravel drive. DITCHES, on the hand, would! Cut them straight across from one side to the other, if they hit them at too high a speed, it'll damage their car. So if you do that, be sure you post signs warning them and take some photos of those signs.

Again, good luck. People like that can really ruin your life if you let them.

We have an easement on our vacation property for our neighbor's driveway. It only allows them limited right of way. It is recorded on our deed and it will always be our property. They can only use the drive to come and go and park their cars. We have our own driveway so we don't have to maintain it.

I wish you luck. I agree that the best thing is to move because you will never win with this type of person.

Can't you take legal action to rescind the right-of-way? It seems there's a way to legally undo just about everything these days.

I doubt there is anything you can do to rescind the right of way, since that was probably in the deed when she bought the place.

I sympathize. There was some land locked land behind our place and one of the neighbors wanted to buy it for her daughter and asked me if I would give a right of way. I said no. I figure if she didn't want her daughter living on her place...and she has much more land than I do, I don't want her living behind me.

If you sell land, you have to give right of way. If you buy land near land that is land locked, you don't have to give a right of way to that land. Only if you own it and sell it.
But, if it is already in the deed....that's the way it stays.

As far as neighbors go...that is why I am land poor. I would live in a tent to keep from having neighbors, so instead of building a new house, we bought the land next door to us because of the way it was situated, we would lose all of our privacy if we didn't have it.

Years ago there was a house in my area that had a big trash/burning pile near the road/ditch. When there was a big rain, it would wash the trash into the road ditch, and then 'flow' down toward the State Park lake. I passed it daily when I was walking and each day I grew more disgusted. I guessed too that it might be drawing or harboring rats.
I reported it to the sheriff's office. Nothing was done. I reported it again. Nothing was done. Seems there was a problem with the prosecutor's office doing anything...as the family with the big trash pile was big, and they had a lot of potential 'votes'. I finally told the sheriff's office that if they could not get it cleaned up, I would be forced to contact the TV station community action team....and that maybe they could do a story with the big trash pile in the background. I also stated that I really did not want to have to do that, as it would/could give the county a 'black' eye. Guess what! Magically the big ole trash pile got gone and has not been back since.

Possibly you can find out if what all they have on their property is legal. Too many junk vehicles qualifies it as a junk yard, and needs a permit/zoning. Possibly all the other junk would put it in that catagory too. Possibly they would have to put up a privacy fence or something to protect the public from the eyesore.

I too think the speed bumps sound like a good idea....particularly where your gravel ends and theirs begins. That way they could not drag yours away, or spin it all off the drive at high speeds. Why not talk to a paving company about putting in whatever permanent bumps it would take to get the traffic slowed down and protect the drive?

I would also note the vehicles coming and going if possible...what the vehicles are, when they come, and when they go. It sounds to me too like it is a drug dealing situation...Do a lot of the vehicles maybe just stay about 5 minutes? A friend of mine had a dealer as a neighbor in the rural years ago. He noted what vehicles where coming and going and that most stayed less than 5 minutes. After the county sheriff became aware of the situation, they frequently drove by real slow. Once the dealer was aware his place was being 'watched' by law enforcement, the activity slowed and finally stopped.

Sounds like you have an easement of property,which should have been in your closing disclosure when you bought your house.If not I would go to city/county you live in and also contact the selling agent you had when purchasing your home.
We just went through the property line issue and it got nasty.The neighbors put the house up for sale and we took back our property.

I guess it depends on the state but here in PA there are statutes to protect a property owner from being landlocked. We have a right of way to the road above us, our current neighbors may or may not like it, I know the one that originally 'granted' it did so against their will but it was court ordered. This all happened before we bought the place.

We share the top of our driveway with a gal that is a few bricks short, she is a real challenge so I can understand what you are going thru. I vote for the speed bumps!

You may find nails in your section of driveway if you go that route...instead I'd order more gravel, have it spread & spray it with bright, bright paint. Then sprinkle ready mix cement mix on it & wet it down- it holds together better than you'd think. Take pictures...lots of pictures. If they dare to move it the difficutly of the chore may shock 'em- but the colored gravel should be evidence enough for authorities.

Next best option is try to buy them out, which is cheaper than taking a big loss on a home you love. Good Luck!

I agree with WANTORETIRE...sounds like potential drug activity to me. Wouldn't it be fun to dig a deep hole in the driveway and see them fly right into it in the middle of the night? WOuldn't it be interesting if you thought you heard a gunshot & a woman screaming in the middle of the night...of course that could have been a nightmare...but you're not so sure, so maybe let the police decide! Evil aren't I???

You might want to look into developing a different drive way into your property... then offer to sell them the right of way & then add the fence/barrier so you don't have to see it.... just a thought & probably not possible.. but may be worth checking out. Especially, given the state of the real estate market these days..

Assuming that it is on the title to your land, were you aware of the right-of-way when you bought the property?

If not, it seems to me that your lawyer and the title search people have some answering to do to you - you might be able to sue. Probably not a bad idea to rattle their chain a bit ... they could well offer some suggestions as to actions that you can take and stay within legally permitted actions.

I'd post speed limit signs, fairly low ... do you have children visiting at times? "Caution, children playing" would be helpful.

Don't dig a serious hole, for then they can sue if they suffer damage. Unless you put up a warning sign about that, quit likely they can even if you do.

I'd certainly re-steal your gravel ... and, as someone suggested, add some distinctive markings like paint. Maybe the concrete-like stuff ... though I don't think that I'd want to give them a paved driveway instead of a gravel one.

A speed bump, *after* posting of speed limit signs, sounds like a good idea.

And raise Cain if they monkey with it - I don't think that they can mess with your property.
