I don't know if anyone can answer this for me but thought I might get some feedback here.I know laws differ from state to state.Anyway,here's the deal.When my mom and dad passed away(dad first,then mom)they owned their home free and clear.There was no will to probate and they didn't have anything of value but the house.No bank accounts or savings.Sibling had POA for mother before she died.At that time he sold the house on a lease purchase deal and used the income to help with mom's expenses.There has never been a deed transfer and the home is still in mom and dad's name on the tax roll.I don't even know if anyone is still living there and obviously the person he sold it to hasn't paid for it in full or they surely would have changed the deed over by now.My question,would the house be mine and his equally? I'm pretty sure he can't transfer the deed to it without my consent but I don't know if I am entitled to half.The state is TX.
