How can this be - litigation - Ontario?

2 years ago my friend was in a car accident that wasn't her fault - the other driver went through a red light and smashed into her car totaling it. He was driving a Hummer.

My friend was injured but not severely. She was off of work for 6 months and she is still suffering aches and pain, loss of balance from the accident, deformed breast from the seat belt, swollen leg. She doesn't like driving anymore and is very nervous now behind the wheel which isn't a good thing because she reacts to things she thinks might happen while driving. The insurance company paid for her time off of work and for physio, etc.

At the scene of the accident my friend heard the driver admit to the police that he was at fault, he went through the red light.

My friend has heard nothing about what happened to the other driver. Was he charged, etc. She was asked once to attend court but then it was canceled. For 2 years I have been wondering why she hasn't heard anything about what happened to the other driver.

She didn't really want to sue, she said it was an accident but then as the deadline neared she might sue so she went to a lawyer and was advised that because she wasn't severely injured or there was no loss of limb or eye or she wasn't disabled she wouldn't win any damages other than what she already received. The deadline for her to do anything is now passed.

2 weeks ago just days before the deadline she was given notice that she was being sued by the passenger in the other vehicle for $2 million dollars. How can this be? How can the wife of the person who was at fault sue my friend for her injuries? This woman's sternum was broken in the accident and there were other injuries and then injuries after that from falls because of loss of balance. My friend had the same problem with balance and has fallen many times since the accident but hasn't injured herself except to scrape her knees and her dignity. Kathy was also told the woman divorced her husband so she could sue him too.

I just don't understand it. This woman's husband was at fault why is my friend being sued? My friend was just advised to retain counsel and she just may end up having to pay something. She is going to finally talk to the other driver and get another lawyer to fight this.

My friend has gone though so much these last few months. Her Mom died in March and then recently her Mom's sister passed away suddenly and now this.
