Conflict of interest is why an attorney won't do it. There are lots of companies that specialist in just what they need. Don't know where you are, but I'm posting a link to a company in California. I'm sure there are some companies like this in most states.

She is thinking of trying an online company like donna posted above.

Does anyone know of the success rate or have any experience? She does not have (nor does he) the money to get attorneys...that's why they have put it off.
But now she found a guy she wants to date,(and he wants to date her) but he is keeping it VERY casual because she is still married.

New beau was burnt before in similar scenario when wife went back to hubby - can't say that I blame him, really.
So now that she has a good man in her sights, she is getting serious.

Her Ex is fine with moving ahead with divorce and is agreeable to share cost.

There are brick and mortar places just like those online. Look in the phone book under "Divorce". I found 6 of them in our local phone book, including the one I posted a link to. It will only work if the parties are in agreement, which it appears is the case with your friends.

I work for an attorney (not a divorce attorney) and several of our clients have used places like these. I haven't heard them make negative comments about them, but I have no personal knowledge.

That's ridiculous. When I got divorced, we used the same attorney. Fortunately, it was MY attorney first so I knew I was getting the best possible deal. Since X and I agreed on the settlement and were not fighting about anything, he said let's just use your attorney to write this up and finalize it and that's what we did. The entire divorce cost us $1,000, plus we were able to remain reasonably friendly.

She should keep looking. However, I would not try a do it yourself divorce. She needs to have an attorney look at the papers.

Here is a brochure I found online that lists attorneys who are willing to be collaborative in divorce proceedings. This is what she needs and they do exist. I don't know where you live but perhaps if she called the number on this brochure they could direct her in finding similar attorneys in her area.

What state are they in? In Idaho, the court has a website with all the necessary forms for divorces and explicit instructions on what needs to be filed and how.

I just want to add that my attorney is part of the group in the above brochure. This is not something random I found on the internet. The attorneys listed here are good and above-board.

When I got divorced in California, we were able to do it ourselves only because no children or joint property was involved.

Dedtired, I was going to say that's what my ex and I did too.
I got the attorney...he knew I was not out for blood and was going to be fair. I bought his share of the house..we split personal stuff, cash was split 50/50, I bought him a living room suite, no kids. Done.

My friends is a little trickier as they own 2 properties. The second is undeveloped land and not worth as much as the house.
They do not want to sell either property.

Maybe the husband and wife should sit down and write down what they want and agree on, then one of them go to the attorney. It could be done in steps with the one bringing home papers for the other to read and sign. I don't see how that could be a problem.

It's a shame things have to be so complicated. I am sure it is due to money. I went to an attorney to counsel about what would happen to me financially after my husband was diagnosed with AZ. He didn't want my husband there, he only wanted to represent one of us. It worked. I went, then went home and told my husband everything. If it had been a divorce situation I would have brought home papers for him to read and sign.

Laws vary. There can be a conflict of interest to represent both sides, however some can do it with waivers. Worst case scenario is one side to have the attorney draw up the agreement and the other sign it, essentially representing themself. Not a big deal really if they truly are in an amicable situation. Cost of an attorney isn't that much if both agree. They charge by the hour most of the time. If it's just read it and give an opinion on it, it certainly wouldn't cost much. If they can't afford that, there's some other issues.

Back when my brother got divorced, he was going to sign off on his wife's lawyer's stipulation. I looked at it and said he'd better get an opinion on it. I didn't like it. He too was worried about cost and I said I'd pay for an office visit with a lawyer I trusted so he could get an opinion. If he didn't like what the lawyer said, no cost to him. When the attorney read it, he started laughing, tossed it across the room and said, "it's not even legal". His wife hired one of those franchised lawyer places and their fill in the blank forms (so you could just as well have done a DIY job). You probably would recognize the name but I won't name the outfit. Cost him a lot less in the end than he was going to settle for, even figuring in the legal fees. The attorney told him he could certainly give her that much but he certainly didn't owe it to her. My/his attorney wrote the agreement and made a couple phone calls and a letter or two and neither (my/his) lawyer nor my brother had to even go to court since they signed off on the agreement sent to them. Sometimes a lawyer can save you a lot of money. Actually it was very amusing.

Personally I'd probably have a competent lawyer at least look things over but that's up to them.

Look for a Divorce Mediator in the area. My husband was married previously. His first wife left him for another man. She packed up all her stuff, and moved in with her boyfriend (now her 2nd husband). She even "divided" their household belongings, taking half the silverwear, leaving him with tablespoons for only six. They had lived apart several years but then he met me, so he wanted to end the marriage. He got a book "Divorce Yourself", filled out all the paperwork himself, charging her with "desertion". He was the plaintiff and she was the defendant. She didn't object to anything, so it quickly worked its way through the court and the divorce was granted. I think everything all together cost him about $200 in filing fees, etc.
