Feeling Stuck and Helpless....

My SD's mom moved out of state in April 2007 leaving SD with DH and I. SD visited BM during the summer and BM came to visit over Christmas. In July 2008 BM moved back. Now BM is demanding that everything is her way and I have no right to do anything help with SD.She had no problem with me taking care of SD when she was out of state doing whatever is was she was doing. Before BM left state the living arrangement was that SD live at our home one week and hers one week. Upon BM return to state we had an informal agreement that SD would continue living with us and visit BM on weeek-ends, as she is living in her mother's garage that has been converted into a bedroom. SD and BM share this room and also share a BED! BM changed her mind and threatened calling the police if we did not return SD on Sunday as the original custody agreement stated. We felt that we had no choice. BM has also served us with child support paperwork stating that she should no longer have to pay because SD is with her half of the time now. We have gotten a lawyer to obtain sole physical custody of SD, but we are so worried. How can BM pick and choose when she wants the custody agreement in effect? By leaving state didn't she basically abandon the original agreement? She was out of state for 15 months and wants to come back and have everything be exactly the way it was before. DH and I have provided a stable and loving home for SD. BM is living in her mother's garage for goodness sakes! We just feel like all of this money and heartache going to court to asure that SD is in a stable and proper home may be in vain. I guess when you go to court you always take that chance.
