Moving???

DH went in for what was suppposed to be the settlement conference.

The GAL didn't have time to do anything so everyone got sent home--DH, BM, and both their attorneys! How annoying! The case has been rescheduled for December 9th. Lovely.

DH has a new attorney--he hired her a couple months ago---not to fight anything, really, but just because he wasn't very happy with his old attorney and wanted to make sure he had someone EXTREMELY COMPETENT to wrap everything up and tie up all the loose ends. For example--SS gets 3 weeks for fall break, Christmas break and spring break. (year-round schedule) My DD gets 2 weeks for Christmas and 2.5 for spring break. We want to make sure we get 1 week of each break for vacation--then BM would get a week, and the last week would be normal schedule.

We also want 1 week in the summer for vacations, etc. As it is now, the longest stretch we have SS is 5 days and it really sucks to have to ask BM if we can have him for a full week to go anywhere. Inevitably, she says no.

Just little stuff like that needs to be ironed out.

Here's the kicker, though. BM's husband is going to Houston, Texas for 6 months. Apparently, (and BM tends to exaggerate things, so I don't even know if this is true) there are govt. jobs for the Hurricane Ike reconstruction stuff. He lays tile for a living and a friend of his got him a job down there---supposedly he is going to make $5000 a WEEK???

Anyway, BM is talking up a STORM about wanting to move down there.

AUUUGHHHHH!

That just can't happen. I honestly doubt it ever really would---but just to be safe, DH has called his attorney and we're waiting to hear back from her what she thinks about that.

In a 50-50 situation, how common is it for a judge to allow one parent to move with the child to another state? DH has ALWAYS shared 50-50 custody with BM; he has always had a HUGE role in his son's life and I don't see HOW it could be in SS's best interest to lose that relationship.

Opinions? What do courts normally do in situations like this?
