taxes

I had a question about taxes. It's probably different in each state but I was wondering how it is for others. My DH & his X had a child support order in FL after their divorce & the state takes a % of each of their incomes, DH pay 70% & she pays 30%. Each agreed to take one child as a dependent on their taxes. The BM is primary caretaker & now resides in TX. DH lives in WA state. She is questioning their arrangement saying she should get to claim both kids. I know she is able to claim them both as earned income credit but he has always claimed one as a dependent as first agreed. Is he being unfair? Should the primary caretaker be the one who claims both (2 girls) as dependents? Any experience with this? Thanx
