Would you accept a bulging wall?

(Posted also in Bathrooms). We are having a bathroom remodeled in our 80-year-old house. The contractor removed plaster walls down to the studs, and replaced with Durarock (sheetrock for wet areas). One of the walls is bulging slightly. It's not outrageously bad, but it's definitely something you notice without straining to catch it. My contractor says this is caused by old studs underneath that weren't exactly straight, and apologized for not catching the problem before the walls were tiled. Fixing this would require ripping down the wall, likely losing all the tile on it, and starting that wall over. He has not offered to do that. What would you do??? I am torn. I feel like we are paying a ton, so it should be right when completed, but I don't know if I'm being too picky.
