real estate law

My mother was the high bidder on a piece of property that included a partially constructed home. She tried in vain to get financing for this property over a 6 month period. Ultimately, she paid more than it was worth. At the auction, the only person bidding against her was on the other end of a phone. This person turned out to be the auctioneer's brother. Later, the brother told her, had he not been bidding, the property would have been purchased at a much lower amount. She lost $17,000.00 to the auctioneer - the % required on the day of the auction. She has filed a complaint with the real estate association. The response to this complaint is "...he took bids from his brother, as permitted by law". What exactly is permitted by law? The brother is well known by all that attended the auction. Is it legal to hide the identity of a relative who is bidding?
