I am sorry to hear your predicament! You need to talk to your agent. Normally there is earnest money they deposited which is now forfeited by them as they are past the contingency period presumably - usually it is around 2.5% of the sale price. However it may be best to try to work with them if possible, they may be able to get a different loan.

We recently sold very quickly also. We got and accepted an offer the first day our house was on the market. I definitely think there was some luck involved, with finding the right buyers at the right time. But I also think there were a few things that set our house apart from the ones in our neighborhood (including one on our street) that have been sitting on the market for months. Our house was very well maintained, and all of the major maintenance items (roof, furnace, etc.) had been done within the past few years. By walking through, buyers could see that there wasn't work that needed to be done, and the inspection turned up nothing. The house was also staged extremely well (we were very impressed with what the staging company did), and the pictures our agent had taken were fantastic. I know I am biased, but just looking at the listing online, I think ours stood out dramatically from the others in the area. Also, we priced pretty aggressively. Most of the other houses for sale around us look like they started with high prices and keep slowly moving down. We decided to err on the side of pricing too low because we would rather make a few thousand dollars less than wait six months to sell. It never ceases to amaze me that people (I'm not referring to anyone here) will be trying to sell a house for 750k, have it sitting on the market for 9 months, and can't be bothered to have someone come take decent pictures. No, pictures don't sell the house, but I think they really help in getting people to come look at the house, and no one is going to buy it if no one is looking. Anyway, my point is that THERE IS HOPE. Before we listed our house, we were really nervous and basically assumed that there was no way we were going to sell the house in less than three or four months. We were prepared to wait a year or more because of all the horror stories we heard. But it is still possible to sell a house quickly, when the stars align and all the pieces come together at the right time.

My family was in a similar position a few years ago with a rental townhouse in ok shape but dirty, dirty. We were moving out from my in-laws house and just wanted a place to live. We had decided against an apartment and our unit was the only townhouse in the area in our price range that we halfway like. The previous tenants were very poor housekeepers (fortunately no animals) and the landlord hadn't done anything to clean up either. If we had another house to consider we wouldn't have bothered with it but we needed somewhere to live. We decided to make the most of it, and I cleaned the carpets and scoured the place from top to bottom. We didn't bother asking the landlord for compensation because we figured if they were going to pay they would have done it before we moved in. We did what it took to make it livable for us. Fortunately our landlord agreed to replace the worst flooring after a year there, which was the carpet in the LR and vinyl in the kitchen. After the flooring was replaced the whole house was much more pleasant and we enjoyed living there. If I were you, I would do what I needed to in the short term to make it habitable and focus on moving into your new home in a few months. I wouldn't want to spend a lot of money trying to get out of my lease, or paying rent on two places just to keep from living in the dirty place. It would be taking money away that you could spend at your new place. And if anything it will make you appreciate your beautiful, clean home even more!

roselvr, you couldn't be more wrong, but that's what happens when you make up your own story, including endings. Go back and reread this post, making like you have no clue what is going on. Maybe ask a friend to read it to see if they get confused. I am not the only one confused; it is due to the way you originally told the story. I mentioned that if you would have added more facts to your 1st post - Chin up everyone, our home sold in 2 day, BY OWNER, for 15K over the Appraisal. The Appraisal came in ridiculously low, but then again if you would read the comps they used, you'd see at least a partial reason for it. then a blurb more here about the appraisal.. Next I would follow with, the buyers looked at other houses for more and said ours was the best for the price, and that even though the appraisal came in low and they knew we didn't have the contingency, they are still happy because they can pay the difference. yada yada This just goes to show that in real estate, you never know what will happen! The ONLY mention of Court was due to 'discussion', CHATTER, between ALL of us, as far as what happens, or COULD happen in instances such as this when the Appraisal comes in lowballed. There was never plans that we were going to Court, because they truly LOVE the house, and it meets the list of criteria that they had lined out during their search. There were no threats, period. Had you added this part (about lunch / and discussing) before mentioning court the 2 times you did, it wouldn't have sounded like a threat. As I said, it's the way you told the story. Now if for whatever reason you NEED to feel that we scammed our buyers, then have at it, I don't really care. I have learned that there are people like you and a few others on this board who just can't stand it if someone else has a bit of happiness or good fortune. Hubby and I are thrilled, our buyers are elated. I said that the way you put things made it sound like. After you elaborated, we now know more of the story. I'm probably in the same boat as you FWIW. I highly doubt they will find comps similar to our house due to different reasons, size, shape, landscaping, driveway. So I have a personal interest in a story such as yours.
