Buyer wants pool fence -- would you?

My buyer has requested the demolition of an old unsafe decorative pool fence and installation of a fence to code (or a credit of $2800). This was very obvious when viewing the property that the existing fence is not to code and not something that would have only been noticed in an inspection. My realtor says this is ridiculous and I can reject it -- which I'm leaning towards. I feel this was reflected in the price and the offer we accepted. A fence is a personal preference and only required if he will be renting the property (he's an investor, so he might).

Just curious, before I respond, what everyone here would think or expect. I have no intentions of performing this work myself because the fence has a brick base with brick pillers and opens up a whole can of worms in regard to irrigation in the yard and the astetics left behind in the demo. I attached a photo so you could get an idea.
