Costly mistake with Pebble Tec

I put in a pool about 4 years ago and went with a Pebble Tec finish instead of plaster. I had the builder install the pebble finish all the way to the coping above the water (no tile). I remember doing some research 4 years back where Pebble Tec (the company) said this type of installation was OK. I remember specifically that their Pebble Sheen finish wasn't approved for an out of the water installation, but Pebble Tec was durable enough.

Now I have bad cracks in the pebble above the water. I contacted Pebble Tec about a warranty claim and they've told me I'm out of luck and that they have never recommended that finish for above the water.

Can anyone here help me check my memory? I feel Pebble Tec may be lying to me, but I have no way of verifying my claim.

Note to people considering Pebble Tec: Don't install their product above the water :).
