What to do when the contractor doesn't go 48' down on the posts?

We just had a deck replaced. The contractor we hired said he put concrete 2 feet down around the posts that would be 2-3 feet down. Our frost layer is 48". We told him we expected him to do this after the first day when we noticed one post only 17 inches down and another 23 inches down. Only 4-6 inches of concrete was around them. He said they were a mistake and would be fixed. After he completed the work, we dug up the outside of two of the posts. One was 23 inches down with 17 of concrete and another was 18 inches down with 11 of concrete. We put half down and now we arent sure wether to have him take it all back up and try for a refund, not pay him the other half for the shoddy work and just keep what we have or hire someone else to redo it and take him to small claims for our money back. We could use some advise. The deck is 8 inches off the ground on one level and another section is about 15 inches off the ground.
