Do I need a Pressure Balanced Valve to feed tub?

I'm wondering if anyone can help me out. I'm told by one plumber that I have to have a pressure balanced valve for our new soaker tub install. He say's it's code. (I have searched the local code (anchorage alaska) and can't find that, but will admit that I am NOT an expert on plumbing so I could have missed something.

The other plumber says that the faucet and valve that I've purchased are fine and that pressure balanced is not a requirement.

How do I get to the right answer? If it's optional, I'd like to use the faucet and valve I've purchased, or purchase a new valve that works with the faucet (it's a waterfall faucet dropping into a 32" soaking tub). It's an adult (master) bathroom, so I'm not overly worried about the water temperature suddenly scalding us since we're relatively smart enough not to sit below the waterfall.

Can anyone help me with options to discuss? I don't know who to believe :(
