I Sold My Mom's Car to an IDIOT!

I loved to drive my Mother's 1997 Buick Le Sabra. It was such an awesome car, but when it needed major repairs I decided to sell it for a nominal fee to the Mechanics helper. I signed over the title and gave him all necessary papers.

That was 2 years ago. The Idiot never changed the title of the car into his name. That means he probably doesn't even have a inspection sticker, plates and insurance. The car is in my Mother's name. He could have had an accident for all I know. My Mother's Estate could be sued. He may not even have a drivers license if he is a Illegal Alien.

Now I have to go through all that stupid paper work to transfer the title. I feel like reporting the car as stolen, I'm so mad. Of course, I want.

Thanks for letting me vent.

do you have a written bill of sale?...That should absolve you of the idiot not getting it titled in his name...

In California the seller must file a transfer of sale with the DMV immediately after selling a vehicle. This protects the seller from all accidents/tickets/etc. that the buyer may have in the future. It's too bad your State doesn't require that as well. But as Liz says the written bill of sale should help you to prove when you sold it and to whom.

**I need to know what to do about this stituation, and Im i going to still have to pay?** Short answer if all things add up, no. **I sent in the form stating i sold my car** That puts you in the clear. **Im thinking the Dmv never recieved the paper.** Think again, if they haven't sent you another registration form since, they got it. Simple enough to confirm. Call them up and ask. Untill a new owner transfers title, DMV can't update their info any further so your name is still the last listed owner. When they got your form, they flagged it noting you no longer have the vehicle. That does not remove your name from the list. With any proof at all that you sold the vehicle, you don't owe anything. The towing company can sell the car to recover their alledged loss. It can be retitled via the 'lost title' process. That will require a signature from you . That's about it. The only risk to you as the last listed owner would be if some d*ck head alledges they were injured in an accident with this car. They may sue you because you're the one they can find. Waste of time on their part if you notified DMV. That might require you hire a lawyer to make sure all the paper work they throw at you is processed properly. That would be as far as it goes. Been there, done that.

Hello all... thanks for all the kind words. I am still trying to struggle through the day. Somedays I am ok, but others not that great. It was her birthday on October 20th. She would have been 64 or "39" as she would have said. We went to the park and fed the ducks... she always liked to do that. I also brought daisys and popped the tops off and placed them in the water. I miss the way that I would call her and she would be willing to go with me on what ever adventure I wanted to go on that day. She was always there for me. I know I am lucky to have a person like that and that it was my Mom, but it hurts no less. I am trying to build a new "normal". It is rough though because everything I do reminds me of her. I started to move around furniture in our house and I was thinking that everything I touched we bought together. She was a great decorator and I have no decorating sense at all. I just wonder when the feeling that I am completly lost and alone will go away. The holidays are coming and I hate it. I think we are going to plan a vacation at Christmas so I don't have to think about it. I don't know about Thanksgiving. Mom used to make the best mashed potatoes. This is so freaking hard. I think I am going to check into counseling again. It is so hard because I put on a strong face when I am out, but crumble when I get to my car or at home. I talk to my husband, but I don't think he really understands. What do you all do for the holidays?? Any ideas on how to get through them?

Ooh, I"m the mean mom on this one-no, I never let my kids eat or drink in the car. Ever. Not when they were tiny, not older with fast food, not now as teenagers. I bought my (first ever in my life) brand new vehicle when I was pregnant with my first child. To be honest, I knew that the crud of food detritus that ALWAYS results from little ones and food in a car would be impossible for me to bear so I figured it was best not to even start it. So we never did. I do have to say that if you are going to have a no-food rule in the car, it probably has to be something that starts from the very beginning. I think it would be extremely difficult to enforce once the kids (and mom :) are used to it. Oh, and I am such a neat freak I couldn't bear to let my toddlers sit in a high chair and smear food all over themselves. Just couldn't stand it. So no photos of my one year old wearing birthday cake all over the face, body and furniture, no watching them smear peas into a paste all over "brrr, gives me the shudders to think of it) etc...they feed themselves fine anyway nowadays. They'll probably be talking about mean old mom in therapy for years though! Ann

Stuff happens. What defines you is how you deal with it. You have dealt with it and done everything right and no one was hurt. You're right, it's a good reminder to I had someone back into my car, get out of their truck and look, then pull away and leave. She left three dimples in my bumper. She didn't try to come find me, she didn't leave a note on my car, and she didn't give her contact info to the guy working in the parking lot. She didn't accept responsibility, she didn't apologize --she just left acting as if nothing had happened. That's what really made me angry.

My sister went through this a few years ago here in Oklahoma. And this was on a trade-in at a dealership!! The dealer sold the vehicle and the buyer never took it out of sis's name.

Long story short, here in Oklahoma you can pay an extra $10 at the tag agency to have your name removed from the title.

Ugh. I worried about that when I sold my car 2 years ago. At that time you could pay a $5 fee to file paperwork stating the car was sold and to whom. This just served as a backup in case the buyer did not finish their paperwork.
I understand that this process is now free in TX.
Sorry this happened to you, but maybe someone reading this will be saved the same pain.

I'm in California -- I sold a car to someone and we went to the DMV and stood in line together to change ownership. That way I knew it was done and didn't have to worry.

I'm very sorry about your problem and I hope it's not as much of a headache as you anticipate. (It's a good thing you found out about it now, before anything bad happened.)

Gayle, that happened to DH. He started getting tickets for using this toll road we have in Tyler. The new owner was using it and didn't have a Txtag. It was a mess.

I know a number of peeps who do that a lot...difference is, the car isn't being driven and never legalized. Often the car will be traded/sold to someone else without ever having the title put in their name, (jumping title).
Kinda normal around here for some peeps.

I don't know what states you are all in, but here in PA we get an annual renewal of tags from the DMV. I'd think after receiving this renewal (if your state does the same) you would have realized they had not changed ownership.

I also accompanied the new owner of my old car to get the tags change with me present. This way, I know it was done.

it wasn't too bad when it happen to me..i just gave all the information to the dmv...(ca in the 80's)

I thought you were supposed to remove the tags from a vehicle when you sold. The new owner has something like 10 days to get new ones. Since the police like to pull over cars without tags, it'd be an incentive to go get new ones.
