teen illegally downloaded movie, now i'm in trouble!

teenagers, can't live with them, can't kill them....uggg!!

my 17 year old apparently has downloaded movies off the internet onto the computer in his room. this kid is a computer whiz, he is light years beyond me in his computer knowledge, he encrypts stuff so that i have no idea what i'm seeing when i check his computer..so i have to rely on his honesty (or dishonesty!) as to what he is doing. i received a "Notice of Action under the Digital Millennium Copyright Act" letter from my isp today. i am completely freaking out here. i am not sure what it means, if i will be sued or not. i know my isp has stated that they have the right to cancel my service, which i understand and if that is the only thing that happens i will feel very grateful. what i am worried about is being sued. i've read the horror stories of parents being sued over their kids illegal downloads of music. i know that i need to be ever-vigilant of my teen's use of the computer, and i try to be. i am contemplating removing the computer from his room and putting it into a more visible area of the house, and monitoring what he is doing. he will be 18 in september and i hate having to treat him like a child, but i guess i need to in order to protect myself. my question is not how to deal with my teenager (nor am i asking to be blasted for this situation occurring in the first place, so please no lectures, i'm feeling fragile and i might cry!!).

what i am wondering is if anyone out there has found themselves in the same predicament and how they handled it.

jiggreen, I feel for you! I don't know anything about this but perhaps you should call a lawyer and see what they have to say about it or know about this kind of thing. They might be able to put your mind at rest....

I agree, you might want to talk to a lawyer just to see what could happen. They might just threaten you with action but not do anything. I'm never sure how far these companies are willing to go when it comes to one person (well, a whole bunch of people, if everyone illegally downloads).

For now the bigger issue seems to be his computer usage. I would definitely move that thing out his room until he understands it is YOUR butt that something happens to if he does something illegal. The stuff you've been warned about could be just the tip of the iceberg in terms of illegal material, i.e. explicit images, etc.

What you need is the help of a computer specialist that can teach you how to put the basic security measures on your computer. And tell them that your son is a whiz at figuring stuff out. If it doesn't completely stop him, it will at least be a deterrent and you can take some action in the meantime. While he's at school, go in there and look at everything he's been looking at. Then have it completely erased and move the computer to a central location where you can monitor access.

My sister (who does know a thing about computers, fortunately for her) went through this same thing with her similarly aged son. It was no picnic but basically she played his game...very well...and it scared the crap out of him. :) Needless to say, he is much more respectful of her and I don't think she has that problem any more.

Thanks all... we do have AAA, though I would want her to call us first. And my thought about the gas is similar to gsciencechick -I'm going to figure out what I've been paying and offer her that, and the rest is up to her. Like daisy, our oldest just didn't push the limits, so life was easier. I wish we could go to bed and set an alarm, but honestly, neither my husband nor I seems capable of doing that. DD is and always has been a really energetic, fun-loving girl, hell bent on making life a grand adventure. Nothing wrong with that of course, and to her credit, she has steered herself well away from the 'party kids', so I don't truly worry about that, but I sometimes just feel like it's exhausting just supervising her. The last two days of school they were released at 10:45... She went to the mall, then to lunch with friends, then to a pool party, then to dinner, then wanted to go to the mini-golf place at 9. Repeat the next day. She works so funds this herself. I'm sure there was a day when I lived life at that pace too, but I can barely stay awake past ten these days. Our rule is that she must text us from the place she is at prior to moving on to another location. She bristles even at that (who knew texting while you were out with friends could be so invasive LOL!). Her view is that as long as she's home by curfew, we don't need all the details. Mmmmmhmmmm. So while I don't honestly worry about 'partying' (though of course I am always looking for signs of anything along those lines) I do worry about her general safety. In the car, on fast roads, in parts of the city they ought not to be, etc..... When I was a teen, I was a very straight kid with lots of great friends, and I had super strict parents. I was always the one in our group with the most limits. I not only resented it, but remember thinking, "This is so stupid, all this wasted worry and energy on things that are never going to happen." For example, my bestfriend's parents were going to be out for the night, so we would want to hang out at her house. It was just so great not to be under adult supervision all the time. We'd watch a scary movie, throw popcorn at each other.... the idea of having a party or sneaking booze in was not even in our universe. But that's what my parents would express to me. "How do we know you aren't going to .... blah, blah, blah." It all seemed to stupid. Now I feel a bit like I'm on the other end of it. Thanks for all the thoughts. I realize things are different now in some ways than when i was a teenager, but not THAT different. There were always parents who weren't around or who were but looked the other way or who THOUGHT they knew what their kids were doing but were wrong. There were kids who drank and did drugs and had sex, and kids who didn't. I think this is why it's so important to do one's best to keep the lines of communication open. Easier said than done, I know. My kids are under 10, but i already see that it can be a challenge to get them to talk about what's really on their minds. I do think kids are always being forced/encouraged to grow up faster than they should in some ways--just heard from a friend that her boys' overnight camp had "socials" with the girls' camps--the younger boy is only 8!! I live 4 blocks from a public high school, and a mile from a middle school and a private boys' high school, so i see some of the same stuff pecanpie mentions. My kids will be able to walk to middle school and high school. Because i work from home, i plan to make my house the most welcoming place i can for them and their friends after school! That said, I'm not sure i'm such a fan of the 'hanging out in malls' method of dating. Yes, it means they're in groups and in public--as far as you know! But there are a lot of places to go in malls where you can pair off and no one's really paying attention (you'd be surprised how much can happen in a store fitting room!). Seriously, i think someone already said, where there's a will, there's a way, and sometimes it's even worse in a group b/c there's more peer pressure, whereas if the kids are one-on-one, maybe they can relax and be themselves a little more (of course, depends on the kid). otoh, maybe they'd be more awkward together b/c of not being used to being left alone! I must confess that i went on my first date at age 14, with a 16-yr-old boy who drove. My parents had met the boy and his parents before the date (but if they hadn't, they still would've okay'd it). He still got the usual grilling when he picked me up at their house, and i got the grilling when i got home (not too late, either!). When you have to meet the parents and chat with them, i think somehow it instills a little more fear/respect that someone's monitoring the situation. This doesn't usually happen when you're meeting a group at the mall--anyone can show up, and you may not have met half the kids. I also think that letting them go on a date is a very individual decision, depending on the maturity of the teen and how much you feel you can trust them. If you've discussed the situation thoroughly with them and think they're mature enough to make the right decisions about it, it shows that you trust their judgment, and if they feel trusted, maybe they're less likely to want to betray that trust (or they'll feel darn guilty about it, if they do). My parents were maybe a little unusual in that they're pretty far apart in age, my mom started dating fairly young and married young (though not so young for the time), while my dad married a bit on the older side. Thus, my dating at that age, and dating older boys, didn't seem unusual to them (or to me). Again, i think it depends on the individual situation and certainly if the teens themselves indicate they don't feel ready, there's no reason to do it, but also letting them go on a date doesn't mean there are no limits put on their behavior.

And today is my first visit here after looking up adrenaline I sure understand better now That's what I have going on MY NATURE'S PACE MAKER.working. Adrenaline After a stay in icu heart recently everyone finally agreed i am mot crazy.it was.my heart. The docs installed is a device catch my heart acting badly is a heart tracker like halter monitor. Under my chest muscles on top of my heart. I can cause it record what just happened.. iam write with excitment because your stories are all so familiar. These stories for me begin after mitral valve repair. 7 years ago. Basic problem ..unless the doc sees the heart behaving badly they deny the problem. All this time we never could catch it Last doc said bluntly if we dont see it didnt happen. You must to er Well recent at 230 am it woke me up, just as you have described. I went directly to the er They caught the serious thing! Arrithemia and more then two days in icu. Now meds have slowed my heart from 70 to 52 while docs decide what to do. Last night I realized I was having an adreilin rush. The same rush I went to a neurologist for help. Over a year and half. Often it also affect my skin. Goose bumps crawling feeling all day long! Well have I got news for him.I was not crazy about that either. my gp I visited last month just to say. I know you don't know what is wrong but I still got it. Knows too I sat in neros office two months ago ,,,same thing. I said dr i just want you know ME when I end up in er..and i need you. well it was er straight to icu. Home now with electrical issues. Last last night meds have my average at 52 bpm.it woke me. 2 3 am. I use my tricks to get back to sleep.as soon as felt sleep coming on the stomach feeling spread. It woke me up heart pounding.sweat .out of breath!!! Happened several times . then checked average heart rate on my Garmin. 48. Average 48 so i was probably lower. Maybe 45! My natural pace maker kicked in every time sleep lowered bpm and I was short on air. Natural pace maker? Adrenaline can't wait to see what was recorded on my device Thank you body! Now I think i know what as going on for long time hidden from doc view. Electric shock adrenaline style

Wow...someone just gave me the link to this post, and I am both happy and sad at what I've read. How can ANYONE say that humans are *above* animals??? These are not just pets...they are souls. And who is anyone to say or know that animals are "below" us? Just because we can talk and have jobs and blah blah blah? No...that's just plain wrong. Animals are extremely special, and if anything, THEY are more superious than us! As for pets, if someone looks at a dog or cat as "just a pet" that can be easily replaced, then don't get one! Because a time will come when you may have to make a very important decision about healthcare, and that "pet" is better off with someone who will make the right decision. Now, I am in no means a rich person. FAR from it! But my dog (a labrador retriever) was diagnosed with cancer when she was 6 years old (3 years ago). I know most people would not give the dog treatment, and if you don't have the means, then I can completely understand. But for those that say "my dog/cat is part of the family".....would you let your son or daughter suffer and eventually die from cancer without even doing anything to help them, even if it put you in debt?? I don't think so! Then either take out a loan for your dog/cat, or STOP saying they are part of your family. Needless to say, I did the treatment. Yes, I know she wasn't a puppy...but she still had years of life ahead of her, and she deserved those years. She still thanks me every single day for what I did for her...in her own little way. The treatment consisted of spinal surgery to remove the tumor, followed by 3 weeks of radiation treatment. The cost? Altogether it was $12,000. Now, many of you may think I'm crazy, but my dog is still here with me, and she is the most amazing creature I've ever known. There are people that spend that kind of money on materialistic things in a year's time. I mean, who here has more than $12,000 in credit card debt? Who here has that debt from clothes/furniture/etc? Here's my point: Most people don't have to face the decision I had to make. But I hope you can look at what I did and realize that a few hundred dollars for treatment or even just a "check-up" isn't too much if you really love your animal. If you TRULY can't afford treatment for your pet, fine. But really THINK about whether or not you can really *afford* it.....I'll bet you can, you just don't want to, or you can find better things to spend the money on. Thanks for letting me "vent".

I agree with Phyllis. Take the computer out of his room, take it to a computer specialist, have him LOCK it so only you can use it, or your son can for school use only (i.e. MS WORD).

THEN, tell your son this is what you've done and why. You can't trust him

THEN, call your ISP, tell them what happen, what is their couse of action, what do you need to do.

Yes you're treating him like a child, #1 he is, #2 what he did tells you he is immature and acting like one so you need to treat him like one. #3 when he is an adult and responsible for himself (meaning his butt gets put in jail not yours), then he can have rights back.

Hopefully the situation won't be as serious as you fear. I have a feeling this notice may go out to many teens.

I would bet he understands that what he did is stealing but may not understand the complete seriousness of it. And, I think some kids really get a rush just to be able to download a movie more than they really care about the free movie itself. I would have a serious talk with him about stealing and understanding how serious this condition could be and how you are responsible.

I guess the rest of the punishment really depends on you and your child. Is he generally a good kid? I don't think all trust is lost and I don't think it's necessary to treat him as such. Kids have a funny way of living up to our expectaions of them: good or bad. Mistakes are made especially in the teen years. But, you know your child best and are best to make call on if you can trust him or not.

And, as one poster suggested you could consult a lawyer to set you mind at ease or maybe there are some other computer savvy friends you could discuss the issue with.

Lawyers? Drastic measures? I would call the folks who sent you the notice first and find out what it is and what it means. Don't see much sense in agonizing over what you might imagine before you find out what's really going on. ISP's do this kind of thing all the time. You're just one hundreds if not thousands. Call them and ask.

You can handle your relationship with your child on your own time. This is an innocent third party who is alleging some sort of violation and needs to be dealt with adult to adult.

I believe the notice is an order for your ISP to remove their content from their storage (web page, ftp area, etc.). This is the time for you to clean up both your public stuff (web page areas, ftp downloads) and your personal computer to get rid of any illegal material.
