Car fraudulently registered in my name, going to court

Any advice about this situation would be appreciated:

I was recently notified that my driving license was withdrawn in the state I lived in 10 years ago. Turns out that an 1979 Mercedes registered in my maiden name was ticketed for expired registration in 2007. Since the ticket was unpaid and the court appearance unattended, a bench warrant was issued against me.

I called the ticketing municipality for details, and the car was parked in front of a house I sold in 2000. I can only assume that the people who bought my house (and did own an old black Mercedes) somehow used my identity to register their car. Since the notifications had gone to my former address, I was completely unaware of the situation. They've since lost the house to foreclosure, and I have no idea where they are.

The day after I learned all this, my husband immediately went to the municipality to pay the required bail (!) to lift the warrant, and I now have to attend a court hearing to prove the car wasn't mine.

I'm puzzling about how to do this, and am wondering if I should meet with a lawyer. I can prove my state residency with income tax returns and various bills, but don't know if that's enough.

I've got the VIN number of the ticketed car, but according to Carfax it doesn't have enough digits.

I'm requesting a Motor Vehicles history for myself (from the state I used to live in), to see if any other cars have been fraudulently registered to me.

I've checked my credit report to make sure this identity theft didn't go any further, and thankfully everything is fine.

Any advice??

I think you can handle this by yourself, really. Just come prepared to tell the judge what you said here (and don't go into more detail, just the facts).

Hi Josh, it has little to do w/ using the pic. I thought it would provide a little insight as to who this seller is. I thought the extra info might be of interest to readers. If they really wanted to boycott the seller, wouldn't it help to know as much as possible about who the seller is??? He/she has managed to remain quite elusive, despite selling all over the place. But, FWIT, while I'm sympathetic to Mariava's frustration about others using pic w/o asking first, I have never understood how one can control who can or cannot use the pic once it's on the WWW. Yes, one wants to share the beauty of the flower but not w/ everybody? How could one determine that a lil ole lady, who oohs and ahhs about the pic, isn't going to print the pic for her garage sale and sell for personal gain??? How could one identify motives once the pic is "out there"? It seems a little unrealistic to me and a source of endless frustration as one could NEVER control who uses the pic and for what motive. Whether it is this ebay seller or the hypothetical lil ole lady, neither one is selling Mariava's bulbs, they are both just trying to promote sales of their own bulbs. Only way to control is not post at all or have the most restrictive network w/ whom to share. Where's the fun in that? All a corporation would have to say is that the pic owner, in this case, Mariava, is not a professional photographer and therefore not harmed by their using the pic. Annoying, frustrating, infuriating, YES, but w/ legal standing, I doubt it. I guess you could spend money hiring a lawyer, getting copywright, etc. etc. etc. but, correct me if I'm wrong, this totally takes the fun of the innocent act of sharing a pretty pic w/ the world. M, you take fantastic pics and for years I've admired your love of hippies and your outstanding collection. we are lucky you share. That is way more important, than some jacka$$ abusing your generosity. Not worth another thought. ta ta

Heather, DO NOT talk to your auto insurance company about this for advice on "how to remove paint damage" from your car. That is WRONG. (How would they know how to remove paint anyway???) Never call your insurance company unless the damage is huge enough to have to put in a claim. The reason is that an insurance company will ding you, and count incidents even if you are not filing a claim for it. So if you call them and say something happened to your car, but you are not filing a claim, they will count it against you and your rate may go up. That is the way they operate. It sounds like your paint damage is small and the Claybar suggestion is a good one. I would still mention it to the LL so he is aware of how careless the workers were. I doubt if you need him to give you the workers name so you can pursue this in small claims court but it would not hurt to keep a record of the event. You never know, he may hire them again and they are even more careless next time.

Funny stories about different transactions. Bill_h, I'm glad to read that in the Motor City, it's somewhat of a free-for-all. It just seems appropriate, being the home of the U.S. auto industry. One thing that can work well for selling a car -- if you're replacing it with a new or used car from a dealer -- is what dealers around here call a "courtesy trade." You and the buyer of your car agree on a price as usual, then you and your buyer go together to the dealer where you're buying your new car. The dealer shows your old car on the sales documents as a trade, with the value being the price the buyer is going to pay for it. This saves you on sales tax in many states. The buyer then purchases the car from the dealer for that price. I know of many dealers who will do this for free, as a service to the person buying the car from them. A few charge the buyer a standard "paperwork" fee. They're willing to do it even though they make no money on the sale of the trade because it can help you buy the new car, since the buyer is presumably giving you more for it than the dealer would have.

hmmm...how are things going? What a loaded question. My doors are still not painted. Well, the MBR ones are almost done. I have these doors primed. I've now been in my house since 8/04/05, so just over a year. I have had boxes stacked to the ceiling in my children's study and our office. I couldn't stand another day of these boxes in my office with no furniture, so I finally got them out and they are now in my foyer. Shelves are up in the children's study and almost ready to go. I bought new office furniture and am a bit excited about getting it set up. All 30 or so boxes in the foyer are starting to dwindle down now. There are files and books that I have to go through. There is no way I can keep all of this, but I cannot just through these files out. They are from two businesses, four children, over 20 years in the military, college, and 9 years of home schooling, etc. Most of these boxes have been in storage for over 8 years. My DR still has 8 doors almost finished for my MBR. It's too hot to paint here in Florida and way too humid, so I have my DR floor covered up so I paint inside. DH and I don't like it, but we don't have much choice. I'm glad you wrote because I am going to do a weekly goal sheet. I love lists anyway! This is my goal that by next week the MBR doors will be done and installed. Hopefully, I'll start on the kitchen doors after that to finish fine sanding, priming, and then paint. It's overwhelming....I have no help to speak of either. Add to all of this the fact that I do the high school band web site, news emails, and volunteer. And my mother has been sick, a close friend is dying of brain cancer, mother had surgery yesterday...and OH>>> an almost 21 year old and a 26 year old still living at home...along with my 13 & 14 year old kiddos. The 20 year old registered for college and left a note for Dad to pay. Then she took off for Virginia for a week with her brother and did not tell us until she was packing. Dad refused to pay the college bill and she's already missed her first classes this week. She has medical issues herself and will have no medical insurance if she is not enrolled full time in college after November. She doesn't care. Darling Hubby is fed up. I'm fed up. My kiddos are slap spoiled rotten and it's all my doing. The 26 year old made the President's list in college this last term and wouldn't even share his grades. He's been belligerent and distant since he came home from Iraq. They pay no rent and seem irritated and angry at me if I don't do more for them. Seeing no cabinet doors still makes me feel like a huge failure in all areas of my life. I'm irritated and overweight. I honestly do so much for everyone and it's not enough. How do I stop? I need help even writing a new mission statement. I think it should start with: Help my man-child and woman-child pack their bags and take away their house keys. You know what? I just smiled for the first time in a week! I might be on to something! :D You know, I haven't said much here because I haven't had much good to say. I'm really going to try to focus on getting the doors done as soon as I wade through these boxes. I kid you not, I'm thinking of just burning these files. I've already ruined a shredder. I hate paperwork. The only 'good' thing is they're all organized. I'll keep you posted.

Good question because I knew a couple of students that purchased cars and did not care if the car was ticketed because they never registered the vehicle in their own names. I did not ask where they got the liscense plates and the police were not interested.

Are you saying at one time you owned a 1979 Mercedes, sold it, and now you are receiving parking tickets on it or are you saying that you never knowingly owned a 1979 Mercedes and have been receiving parking tickets on it?

Just to clarify, I have never owned a black 1979 Mercedes.

A black 1979 Mercedes was ticketed for expired registration in 2007, parked in front of a house I had sold 7 years ago, in a different state. The registration listed me as the owner and used the address of the house I had sold. But I didn't own the car, never had, hadn't registered it, and didn't live in that state any more. Someone used my identity to register their car, without my knowledge.

I've decided to go ahead and speak to a lawyer about this. I could probably handle the court appearance without one, but want to see if there's anything I can do to protect myself from additional ID theft.

I thought the BMV's computers were linked to a nationwide database.

How could the BMV not see that you have a current drivers license in another state?

Why would they allow this vehicle to be registered without the proper number of digits or correct address?

Perhaps someone at the BMV (where you used to live) knows more than they are letting on?

They spent weeks running criminal checks on more than 600 Marion County BMV employees and found it's not uncommon."

I think hiring a lawyer is a good idea. I'd also freeze my credit report, file a police report and let my auto insurer know what is up, so its on the record in case you get pulled over or have any other ID theft related issues.

After talking to a lawyer and the local police, I ended up calling the officer who wrote the actual summons 4 years ago. He pulled the file on the ticket and called me right back. Turns out he spotted the unregistered car in the driveway of the house I used to own, called borough hall and was told I was still the owner, and therefore wrote the ticket to me. It was just a mix up, not identity theft. Huge relief!

He said he'd dismiss the charges, but I still had to go to court and talk to the prosecutor and go before the judge. I'm now working to dismiss the $100 license re-instatement fee.

Boy, going to court was an eye-opener. People were there for habitually writing bad checks, driving while super drunk, beating up their girlfriends. It was a long, hot, grim evening.

So it's illegal to park an unregistered vehicle on private property? That's interesting. I could see if it was parked on the street...

no vehicle with expired non-current tabs/plates can be parked in a visible spot on private property in our town. it can be inside a garage and out of sight. any trailer, boat, camper, car must be parked on improved surfaces. not on grass/dirt. 4hr limit on city streets in 1 place. no overnight parking. car must be moved at least 1 block to be considered moved.
