Question about creditors...

I have an un paid bill from almost 10 years ago,made by a "friend" in my name. I am still being called daily by the collection agency. Is there a way to stop them? I thought there was a 7 year application of some sort...ty in advance!

7 years is how long you should keep paperwork.
The only rule on bills is they haunt you until you pay them.

Your "friend" might have created the bill but the bill is in your name so you are the one responsible to pay it.

This is called skip tracing. I did debt collections about 10 years ago. It's normally a total last ditch effort to track someone down. You all may seem incredibly annoyed by it, but once in a while you get someone really chatty when you ask if they about someone's whereabouts and you get a good lead. May seem annoying - but realistically they're trying to find folks that owe tons of money, this isn't to chase down debts under $500 it's normally for thousands if not tens of thousands of dollars. Someone CANNOT say, hey I'm looking for your neighbor he owes money. They also are not supposed to tell you they're a creditor. The lines blur a bit state to state about what you can say, but all are covered by the FDCPA. I remember one time I called to get info, and they were like, oh hey he's out in the yard I'll get him on the line. It works, that's why collection agencies do it. One other thing, they may not necessarily be looking for someone's whereabouts. They may be looking to find out random things, where is someone working, etc.

weed If you reread what I wrote you will see that I advised that if the credit cards are only in one persons name the credit card company can not hold the other person responsible, but a court can hold both parties responsible for "marital debt". the problem is the credit card company can only force the cardholder to pay. We ran into this many times at the credit card company I worked for. Card was in wifes name,court said husband had to pay. We could not contact husband for payment,the interesting thing is if the husband was not on the card and the credit card tried to contact him about the debt they would be violating the FDCPA laws of disclosure. the only option was for the wife to go back to court and husband could be held in contempt. A suggestion would be to have the spousal support increased to cover the payments or force the resonsible spouse to transfer the balance to one of their cards. Karla

If they give you the pitocin, get the epidural. I didn't want the epidural but after a while, the pain left me no choice. They gave me another drug before the epidural and all it did was calm the contractions - prolong labor for a what seemed an eternity. Depending on how much they give you, Pit, as others have said here, can be very very uncomfortable. DD was 10lbs and wouldn't stay turned. There was talk of a C-section but she eventually decided it was time to say Hi. The trend is to walk a lot even with pit and contractions going at the same time. That will help, but it can be rough too. I've never heard of any fetal distress from the pit but you and the baby will be monitored. Unless you have a strong coach, I wouldn't try the pit without the epidural or some other paid meds. You will wear yourself out - and you want to have all of your strength to hold that beautiful bundle of joy!! Congratulations and best wishes. Boy, I sure wouldn't pay them. You're saying that your friend used your name without your knowledge or permission, right? If so, you're not responsible legally or morally. In fact, I'll bet the statute of limitations in your state has run by this time, and the creditor will never be able to get you to pay the debt by going to court. They'll just hound you to death to see if you'll cough up some money to get them off your back.

I would make a call to your state's Attorney General office consumer hotline, and discuss whether there's anything you can do about this. I would also stop taking the calls from the debt collector. If you have caller ID, just don't answer, and if you don't have caller ID and happen to pick up a call, hang up.

In fact, I have a creditor who's been calling me for years, trying to get me to pay a debt I know I don't owe. They call every month or two, I tell them to send me copies of the original loan document with my signature on it, they say, "C'mon, you know what this is is about," and I hang up. End of story. Periodically, they threaten to bring suit, and I tell them to please go ahead, and let them know what court is closest to where I live.:)

For that to be true, she would have to file a police report for identity theft.
Which IS an option.

Or it might be less hassle and less expense to pay the bill that is in her name.

Why would she have to file the police report alleging identity fraud? I agree it would make it easier to prove, but is it actually required by some code?

If the creditor ever filed suit against her, wouldn't her written response read something like, "My former friend, Jane Smith, took out this debt in my name, without my permission. I have explained that to the debt collector every time they've called, for the past X years."

I don't specialize in collections, but I would think that part of the creditor's case would be to prove that the debt actually originated with the poster. If she has never accepted it as her debt, I would think that the creditor would need to show some evidence - maybe a loan or credit card application with her signature on it. Then they could argue about whether it's her signature.

I'm not saying this will happen, because I can't imagine they're going to take her to court on a 10-year-old debt, even if the statute of limitations hasn't run. All I'm saying is that it would take a court case to make *me* pay something that I knew wasn't my responsibility.
