Planning for our Death

My husband & I are interested in making a will, a living trust, durable power of atty, etc., but I don't know the type of atty that would specialize in this - would it be an estate atty? Also does anyone have any idea what it costs to set these documents up? Also how do you find out if an atty is any good?

It cost my wife and myself about $2,000 to do this about 4 years ago.

Note that there is a "standard" out there but no state has adopted the standard, so for such plans to be quite reliable you need to consult someone in the state where you are a resident and if you move you may have to change a few things. Some states like Utah and Nevada very different.

Also some pre-death things may be different. MIL found it much easier to get alzhimer hubby admitted in Wyoming than in Nevada and MediCaid was more easily arranged there.

Why are you trying to transform a beautiful, mature beech maple deciduous forest into a conifer forest? Norway spruce is not native and I consider it a weed. Not only will it and the spruce suffer in the shade, if they do grow they will shade out any understory shrubs, forest floor flowers and new beech/maple seedlings. If you want a conifer forest, I suggest you start from scratch with an open field or meadow. Plant it with native pine, fir and spruce seedlings; in full sun they will grow quickly. If you are in zone 4, there should be native conifers, check the USDA plant database (link below) for various conifers (spruce, pine, cedar, tamarack) and see if the map includes where you live. Local conservation organizations and muncipalities often provide low cost tree seedlings to property owners, often only cents per tree. Here is a link that might be useful: Plants Data base

I had nearly the exact thing happen this year (2025). This box had crisis last year when I found the nestlings wet, their nest soaked and berry seeds abundant. What I was told was that the parents were feeding them non-native berries because there weren't enough insects! I took the nestlings out, cleaned the box, replaced with a dry nest and supplemented with mealworms. Two males and a female ran nearly 100 mealworms into that nestbox within the next 20 minutes! It was a rescue mission. The nestlings all survived and fledged three days later. But this year, that nestbox wasn't touched until way late in the season. I was glad to see they were back, better late than never. But maybe not. Four eggs, four nestlings, all looked well. I checked them a day ago, providing rehydrated mealworms. I noticed some dog doo near where I put the mealworms. I wonder if that could affect the nestlings by contamination. I took the bos down and it felt light. I wondered if they had fledged but it was too soon. All four melding together and decomposing! This park is chemical-free, the only one in Orange (CA). All the other nestlings in the other five boxes had a good run. This was a special box and had yet another disaster this year! No evidence of foul play, no insects, etc. Another seasoned monitor told me it might be due to the male not returning, maybe killed in a fight, and the female abandons the nest. The nest box is down, washed out and waiting for a thorough cleaning. I hope they return to this box next season. We'll see. Very sad.

Why did we go with Kvanum Kok? Easy answer - because we pass their showroom frequently, and my wife fell in love with them the first time we saw them. Plus, we both wanted as much wood as possible, including in the drawer construction etc...we looked at Siematic also, for example (which would honestly have been far more practical, in terms of efficiency for the space),but the metal drawers really turned my wife in particular off - plus they were even more expensive. Kvanum has a lot of nice details...hand painted on-site finish, dovetailed drawers, interesting shelving and detail options, nice internal organization options, and they also fairly recently added the option to have the interiors of the cabinets and shelving all be oiled oak veneer, which is very rich looking with the painted exteriors, instead of white or painted. In person, everything about them screams quality, and they are just put together really well with a lot of attention to detail. The fact that they are so unique and uncommon is also selling point, if I am being honest with myself...but I like to think it is more than that. Finally, I love the fact that they are scandinavian...we have a lot of Danish Modern furniture in the house (for example, our dining room table and chairs), so its kind of a theme for the house. The biggest downside is the cost, both monetarily and ecologically, of shipping cabinets halfway around the world. I am sure we could have saved a lot of money going more local, and I am 100% positive that we could have gotten 90% of the look for 2/3 of the price. I can't really justify going with Kvanum other than by illogical gut desire. Our current floor is really bad square ceramic tile...contractor grade, chipped, ugly color. We have wood floors in the rest of the house. I don't have a problem with standing on the hard surface, and it is worth it to me for the increased durability and water-proofness of the tile floor. The reason wood is a backup is because our floor is currently quite uneven, and our KD is worried about the cost of levelling it enough to use such big tiles (the current are like 8" square, but the Xylem boards are about 36x8). We are waiting for the contractor to give us a firm opinion/estimate on it. If it is too expensive, we will do probably oak planks stained/died a similar dark Wenge-ish color.

Melissa, thank you for asking. I have great news about Sebastian. The reason I felt so terrible about telling you the pain would lessen in time, was that I truly expected to lose my buddy of 10 years on Friday. I was hurting terribly, and waited all day for news. I kept thinking about what I had written to you, never expecting that I might lose my own pet so soon after that. I kept thinking that if we need to put him down today, the pain will lesson with time. Yet, it gave me no comfort in the moment, so I felt hypocritical about my comment. After waiting about 9 hours at home to hear what had been found, I finally heard from my son.( He works at a large veterinary practice) Sebastian had megacolon. The reason he hadn't eaten for three days, was because he was completely clogged up from the the stomach exit to the "final exit point". This had been slowly building up over at least a month, possibly two. He is now doing so much better. He's like a young kitty again. He's taking meds, and this may need to continue if this becomes a chronic problem. That's ok with me. He went from deaths door to feeling great, in two days time. The Vet said he was becoming toxic and would have ruptured or the toxic megacolon would have taken him soon. I'm very grateful that I've been given more time with my buddy. I'm sorry your outcome wasn't the same, really sorry. Here is Sebastian this morning, checking things out in the garden. He's feeling great again. Lisa

You need to consult an estate attorney. You can probably search through the phone book for names and set up initial consultations; they should meet with you for free. Then you select an attorney you feel comfortable with. Or you can poll your friends and co-workers for their attorneys' names, see how comfortable they are with them.

Just check around and get a respected attorney in your area. I just had a will, living will,durable power of attorney, declaration naming preneed guardian and designation of health care surrogate all signed, sealed and filed at the County Courthouse for less than $250.00. This was done by an attorney who is well known and respected in my hometown.

Aren't their kits that you can do yourself and file yourself? Does anyone know about these? DH and I don't have any kids and won't ever, so "estate" would go to siblings, which should be a rather simple deal because we don't have much. We also want to set up a trust for the critters to make sure they get properly rehomed and cared for. Of course, we'd have to change the names of said critters as they pass on and we acquire new ones. I'd also want living wills and designation of health care surrogate for both of us.

What county agency does one contact to find out what is needed? Our families know our wishes, but I'd like to get it all in writing. And especially set ip the trust for the critters.

I've seen packets at Best Buy that contain CDs with various legal things on them; I think I saw one for divorces. Maybe there's one for wills?

Meghane, County agencies and courts are not supposed to give out any legal advice at all. You either do it yourself and accept the risks, or hire a lawyer.

A Will, Living Trust, Durable Power of Attorney, Living Will, all that other jazz. God help those that have to deal with them. I'm dealing with two "living trusts' as we read.

Cash out all your income checks and put the cash in a safe deposit box. Sell your house while you're alive (even if it's to your kids). Any other "legal options" will make them hate you when they have to deal with banks after one of you goes. Been there, doing that, ain't no fun.

Be sure all stocks are in a brokerage house, preferably a cheap commission online place.

While you have all this time, see if you can figure out what your basis is for all your stock, unless you're planning to die at the same time (when one of you dies, the basis goes for 1/2 or the stock on date of death for he/she. But the other 1/2 basis stays with the purchase basis.

Am I bitter about this???? You Betcha!!

I know this is not a complete list since the attorney we are meeting with who specializes in these issues does not appear on my state's list. I suggest ask around among your friends, colleagues, shrewd managers of their afairs, etc. for a recommendation.

It seems to me that the whole kaboodle should be set up for less than $500., in a number of cases - but prices may vary widely in different areas.

Check under "Money Saving Tips" forum for my offer of a (no expense) Christmas gift (first written a year ago, recently retreaded, at no out-of-pocket expense to me this year, either) for an idea that may help. If you're not in a hurry.

I don't like the idea of the fill-in-the-blank forms, for your wills, at least. Especially if some of the beneficiaries, or some who may think that they should have been, are inclined to be litigious.

Where there's a way - there may be a will.
