Falsely taking financial gifts for kids

my sister was helping our mom take $30,000. and put it in mine, hers and our other sisters nqame equally, well instead she put the money in her own kids name, my mom didn't realized it until after words since she was put on her check book without any of us knowing anything, can our mom get it back? This was done 5 days after our dad had a massive stroke. What or can she do anything to get her money back into her account to take care of her? When my sister gave us her checking account because she was so busy to do it, her checking has $154.00.

As I mentioned in the post that probably spawned this thread, I'm getting married next month and I, w/the prodding of several friends, got up the courage to ask for a pre-nup. It was really something that I wanted to avoid because I felt that I appeared greedy and lacked faith in him/us. This is not true of me or how I feel. I mistakenly thought that if I was smart about things and never commingled our money and kept his name off of everything, then I would be protected in case of a divorce. Not true. The clincher for me were my IRA's. I also got burned in my previous marriage. I am self-employed. It is tough being chief cook and bottle wash, much harder than being an employee. I don't get vacation or sick pay, I elected not to buy worker's comp for myself, I pay both sides employer/ee of FICA/Med taxes, when work is slow or somebody forgets their appointment, I don't get paid. To that there is all of the overhead. I don't live extravagantly and the one thing that I am determined to do every year is to fund my Roth and my SEP IRA's to the maximum allowable amount. I am counting on this money to see me through my "golden years" - not for trips, but just for survival. My job is very physical and as I am aging I am getting little injuries that don't heal as quickly. This is why I am in school again b/c I physically won't be able to continue my current occupation much beyond the next few years. I know that STBDH wants everything he owns to go to his Adult D's and he has said so many times. I agree that it should go to them. We are both to inherit real estate - the homes that each of us was raised. My STBMIL wants the house to be passed down to his kids, technically I would be entitle to half of it if we don't have an agreement before hand, and he would be entitled to half of mine. To add to this, the older DD is quite selfish and both STBDH and STBMIL realize that there will be a problem when they die b/c she will try to screw her sister our of everything. Both young women also don't know about our marriage plans next month (I think they should, but not my decision nor for this thread). When I asked him about a pre-nup, I mentioned that we should do this because his DD's will probably be very unhappy when they find out we got married and be even more insecure about me "being entitled to things that they believe are rightfully theirs", plus I explained the above. We came up with an agreement that is non-offensive to either of us, protects both of us and especially his kids - and I made extra sure to have a special clause that mentions his kids so that they know we considered them. In the eyes of the law marriage is a contract, although we know it is more than that, and I would have to say that a pre/post nup is just an addendum to that contract. If STB DH refused to do this, I think I would have retained an attorney for options and probably set up a trust for myself. It shouldn't be about business, but when money is involved that usually how it works. We've all heard about high functioning, intact families that come apart at the seams over the family estate.

Actually as an adult with no real desire to interact with this SM and every little interaction (a few times a year for an afternoon?), why bother to give it all so much thought? On the rare times you have to be around her, who cares what stupid fantasy garbage falls out of the woman's mouth? As long as she is not sitting there bad mouthing you and/or your mother, but instead is just rambling on about silly crap that seems in live in her weird little head only, let her. Why a need to confront? You know it's crap. Dad knows it's crap. If someone else also there that hears her, the other person is nothing to you (who cares what some random friend/relative of SM's believes, odds are that other person actually knows the truth too). What it sounds more like, is you're ichting for a confrontation that you feel is long over due. If so, and it really bothers you so much, why even interact with her? Surely in your adult life you've had to spend the afternoon with someone you dislike and/or thinks is 'nuts'. Sometimes such times are due to necessity, other times a mere sense of obligation. Usually in such situations one does not 'call out' the offensive/delusional (unless as said there is bad mouthing and similar offenses going on)....so you have a choice. Either avoid the lady or tolerate her. If you're truly looking for something like a confrontation and a clearing of the airs. One where you get to tell the Sm exactly what you think of her, her behavior over the years and how much she hurt you, perhaps you need to seek out some additional counseling. Not to tell you so much your feelings are wrong or that you don't have a right to feel such way, but instead to help you deal with your inner feelings and positive ways to deal with them. Yes, you are doing some polite interacting with her to 'save peace' a few times a year, but it's leaving you torn and confused. Perhaps the additional counseling could help you decide whether the bit of interaction is the correct thing to do for you personally and/or if it is in your best interest to cease and avoid the visits with her. Right now, you're giving this woman way too much power to control and play with your inner feelings. It's not healthy for you. Example: a future grandchild. You don't see this lady but a few times yourself as it is now. Why dwell on a child that is not here and if Sm does not bother to barely remember you even exist now, I'd bank she'll not have any time or need for the child either. She's just blowing meaningless hot air. She now wants nothing but an occassional few hours a year of your time. She certainly won't become 'grandma of the year' to any future child based on a few times/hours a year. A young child won't even recongnize her from visit to visit and an older one will see right through her charade.

When I was in graduate school back in the 90s, I paid out-of-state tuition (for a U. of California campus) my first year, but jumped through a series of hoops (CA drivers license, residence, paying utility bills--there was a list of must-dos) to establish residency. Starting in year 2 I paid in-state tuition. I had worked for a year and lived independently from my parents for a year before entering grad school. I don't know if there's any difference between undergraduate and graduate school. I think there may be a presumption that undergraduates are still living at home when not at college. If they still "go home" for the summer, they aren't residents. Obviously, that's not the situation for L, and her age and situation (and work/tax history) is such that it should be easy to convince the university that she is independent. This is an excerpt from a Nerdwallet article on the subject, which seems to match my experience. I hope your dad is okay! It seems as if your mom was going thru an emotional time.

If your father had passed away, I believe most banks would freeze the accounts until probate was complete, even joint accounts. So your mother may have been anticipating the worse.

Isn't it possible that there was confusion between your mother and sister, as to who whom, where, and why, in regards to $30,000.

Has your mother asked for the money back? What is your sister's explanation?

If your parents wish to have all the daughters names on a separate checking account then they should set that up themselves, but be forewarned that anyone of the daughters can withdraw any or all the money at any time.

emilynewhome , I really don't think the banks freeze joint accounts. If the account is set up *either or* the surviving spouse will have access to the money.

The bank did not freeze our joint account when my husband died. It think that is an old law that people just keep repeating. I've never heard of it happening to anyone I know.

Technically, the sister did not do anything wrong IF I am reading right and your sister was "put on" your mom's account. If it is now a joint account, then your sister has just as much right to the money as your mom does. That is the danger in putting someone else's name on your money.

What does your sister say about the money?

Is her name on your mom's checking account now?

I am sorry your mom is down to $154. If the money had gone to all three sisters equally, instead of just to the one sister's kids, would your mom have had more money now, and who would help her if she did not? Those same people probably need to help her now.

It sounds like your mom may have made a bad choice of which daughter to trust.

How is your dad doing? I hope he is okay. If your family decided to try to "hide" your mom's money so that Medicaid would pay for his nursing home care, you will soon find that there is a "look back" period in most states. The state can look back at the account balances for several years and tell your mom that she has to pay a portion of that $3000 for nursing home care, even if she did legally give it away. This was put into effect to keep people from pretending to be poorer than they are, trying to keep from having to pay for their own nursing home care. Medicaid is happy to pay for that care, but not until the person in the nursing home has spent their own money on their care. Spouses at home usually get to stay in the house until they die, get to keep half the savings and their own income. Check with your state to find out the rules, before your sister has a chance to spend the money.

I hope that I am reading this wrong and your family is not going through one of these very difficult situations. I hope you are working it all out with the sister. Best wishes,

I can read

Your sister took the money and put it into her kids account instead of the joint account she was suppose to put it into.

Mom can get it back if she can proove the $30,000 wasnt a gift. Are you sure it wasn't?

No matter what you do the money is gone. Her name was on it so it is legal. If she had taken it illegally it would still have been gone because usually people don't prosecute family.

As far as the situation posted, I'd still consult an attorney, to get the best advice and find out if there is anything that can possibly be done at this point. Maybe there is, maybe not--but the best person to ask is an expert.

Secondly--a general comment about transferring money/giving gifts to reduce ones' estate for various financial reasons (to get on medicare/medicaid, to reduce inheritance taxes). Just this morning on the news, a prominent local attorney was saying the complexion on that has recently changed drastically. There are OLD laws on the books making family members financially responsible for disabled relatives (older people in nursing homes, etc). The laws are archaic and really haven't been used in years. BUT the federal gov't and some states are dusting them off and using them to dump financial responsiblity for the expensive care some elders are recieving in the laps of their children. So transferring those assets early isn't going to help, if that practice becomes widespread. Just be aware, the way the economy is going, I think we're going to be seeing more, rather than less of this sort of thing.

Perhaps the attorney was referring to the Medicaid lookback period; if "gifts" were made to family members, or others, during that period, Medicaid will certainly come knocking. The lookback period is (or used to be) 5 years; it may be more now.

Gifts of up to $11,000 to any individual are OK according to the IRS. Suck it up and think back to you 'woulda shoulda, coulda" spent more time with your mom so YOU might have had check cashing privilages.

Well, actually, the "annual exclusion" gift amount is $13,000 to any one or number of different individuals.

Dusting off old rules and going after relatives for nursing home care, etc. is a bit off the mark. Unless...

#1. You somehow inadvertantly signed papers indicating you were the responsible party. Always wise to fully read and understand anything you put your signature to.

#2. You didn't adhere to the 5 year lookback period when paring down assets to get your loved one onto the Medicaid system as opposed to being private pay until any assets run out. In other words - don't divvy up all of grandma's money in July and try getting her into a nursing home on Medicaid in August.

No, actually, there are some states that do have old laws about children being held responsible for the health and well-being of elderly family.
