tax question: can i claim interest on house #2?

Tax Question! Thanks in advance for your help!

My boyfriend and I purchased a house 8/1/2008 as Joint Tenants. The mortgage, title, everything is in both of our names. The mortgage comes out of his bank account each month through autmatic withdrawal. I write him a check for $1200 each month to pay for the mortgage, however. I am a first-time home buyer (this was the first home I ever purchased.) He already owns a house and has owned it for 11 years. We currently have both homes as we are waiting until the market rebounds before putting home #1 on the market). So this new house is his second house and my first.

He is claiming the interest on the mortgage for house #1. I want to claim the interest on the mortgage plus the $7500 tax credit for first time home buyer for house #2 (the home purchased 8/1/08.) Can I do this as the mortgage payment for both homes comes out of his bank account, yet I am paying for it via check to him every month?

If you are part owner of the house, you are entitled to deduct the part of the mortgage interest that corresponds with the part of your ownership -- if half, then half. And your friend can deduct the other half. If you get audited, the only justification you would need to support your deduction is proof of home ownership as joint tenants and proof from the bank statement that the interest was paid. I do not believe you will be asked to "prove" that you actually personally paid the mortgage interest. The only time when such a proof would be required in an audit (I think!) is if there were suspicion of fraud, like if the total interest deducted by more than one person exceeded the actual interest paid. The IRS receives from the bank copies of the mortgage interest paid. So if the bank statment and the total deducted by you and your boyfriend are in agreement, there should be no problem.

As to your other question, about the tax credit, go to the IRS website > and do a search on "first time home buyer" or some similar term. The website is vast, and it will probably take a lot of hunting before you find document you are looking for. Read it very closely to see if it addresses your particular situation. If it does not, you can take a chance and put in for a HALF tax credit, half because only you are a first home buyer, and hope for the best. But be prepared to be questioned on it, and be prepared to pay back the credit, if it was given to you, plus interest. Alternatively, you could call the IRS 800#, and ask your question. In my limited experience, the answer you get depends on your luck. You might get someone who knows the code well and can give you a helpful, informed answer. OR, you might get someone who will read to you verbatim the wording in the code that you yourself could get from the website. Don't forget the IRS code is very complicated, so complicated that even tax experts make mistakes.

Whose SSN is listed on the mortgage interest 1098 received from the bank? If it's you boyfriends it still doesn't mean that you can't claim the mortgage interest, but it does mean that your BF will have to report the interest expense then back it out as reported by your SSN.

Assuming the house you both purchased was over $150,000. Then you should be able to claim the full housing credit.But be advise you have to repay that money back over the next 15 years. Starting in 2010 you'd be paying $500 in extra tax for 15 years. It's not a credit really, it's an interest free loan.

Try this one for the odds and ends: Preserving: End of the Garden Sweet Pickle Mix This recipe is from "Joy of Cooking Canning and Preserving." 4 medium ears of corn 1 pound young zucchini or cucumbers 8 ounces snap beans 8 ounces carrots 8 ounces cauliflower 8 ounces green and red bell peppers -- mixed 8 ounces pearl onions 8 cups water 1/2 cup canning and pickling salt 3 cups cider vinegar 3 cups white vinegar 1/4 cup bottled lemon juice 2 cups sugar 2 tablespoons celery seeds 1 tablespoon red pepper flakes 1/4 cup chopped basil Boil corn 5 minutes and cut from the cob. Wash, trim ends of zucchini or cucumber and cut into 1/4" slices. Wash, trim ends of beans and cut into 2-inch pieces. Wash, peel and cut carrots into 1/4" slices. Wash and cut cauliflower into 1-inch florets. Wash, core, and seed bell peppers. Cut into 2 x 1/2" strips. Wash and peel the pearl onions. Combine water and salt. Pour over all the vegetables. Submerge with a plate and place covered bowl in refrigerator for 12 to 18 hours. Drain vegetables. Do not rinse. Combine vinegars and spices in a large, deep skillet and boil gently for three minutes. Add vegetables and basil. Bring to a simmer over high heat, stirring often, until the largest, thickest pieces are thoroughly hot. Use a slotted spoon to pack the vegetables into hot pint jars. Wow, thanks for all the responses. I am going to have to reread this over very slowly so that I understand everything you all said. To answer some of your questions and comments, it's not too much house for me Gardenspice because I am buying it for cash. Taxes are high in New Jersey. They are $6700. on this house now. I want to make sure I can continue paying the taxes on it when I get older so I don't want to do anything to it that's going to cost me more money in taxes. I understand that taxes go up anyway. But I want to keep them from going up as much as possible. The taxes are one reason I am looking into building an apartment in one of the outbuildings on the property. I'm thinking ahead for old age. I want to keep this house until I die. If I had a tenant, it would help with the taxes. Unless the tax cost of the improvement cancels out any profits I would make on rent. Of course I will look into all the rules and laws I have to follow if I was going to do something like this down the road and I'd never do it without getting proper permits, etc. I wouldn't be able to sleep if I didn't follow the rules! I am also looking into other ways to make some money with this property. Making an apartment was one idea. I've also thought of having weddings and other events there. I'm a bit of an entrepreneur and will do a lot of research. Whatever we do, we will be doing all the work ourselves. As far as what's going on inside the house right now, there are open permits on it now that the code officer told us was transferrable to us so we can complete the work. Nothing is hooked up in this house. The work was in progress and then the owners had to stop. It will take us three weeks to hook it all up. There will be lots more work to do but in three weeks we'll have enough done that we will be able to get the certificate of occupancy to move in. Other than the tax man kind of rushing me off the phone, all the town guys we've spoken to about this property have been very helpful and supportive of us--they want us in there. The house has been empty for a while and I think they're afraid someone's going to buy it and turn it into some kind of halfway house type thing (it's a big old Victorian) and they would rather have a family in there who is going to give it tender loving care. It is in a town with other multiple dwelling buildings, bed & breakfasts, plus it's on five acres. I'm not even sure what I want to do with it and what I can do to it at this point. My goal is taking care of these taxes. Where I live now, on an 11 acre farm in Virginia, my taxes are only $846 a year so this is going to be sticker shock! And this whole thing might be moot if I don't get my farm sold. We lost our buyer two days before closing! Now we're praying the old Victorian is still going to be there when we get a new buyer!

As to home property taxes, Does florida have an income tax? no..... so the money has to come from somewhere, after all florida builds roads ALL the time (I lived there for a decade, if its green pave it over seem to be the motto) The problem to many people isn't the property tax OR where the money is coming from. The problem lies in the fact that so many properties doubled and tripled within the last 5 years; coupled with our Save Our Homes Amendment. S.O.H. says we can't be assessed more than 3% each year. So 2 people can be living in identical houses one paid $100,000; the other 5 years later paid $500,000. The first pays around $2500 in taxes the second is paying over $10,000 in taxes. Needless to say the longterm homeowners could give a hoot less about what the new homeowners are paying. Long term homeowners will only be affected IF and when they decide to sell. It's a very heated issue and one that affects the major cities moreso than all of Florida. Which is why the politicians will walk away from the special session in a stalemate. One other thing. It's totally amazing how many of our cities are unable to cut millage rates. Many cities have seen their income literally double in 5 years, but most have built up no reserve and still cry "if they cut property taxes, we have to cut fire and police".

It is his SSN that is on the 1098. I will do like you suggest and claim the interest expense once he backs out of it.
I have been trying to follow the Economic Stimulus plan and read the revisions discussed on Wed and looks like you are correct that it would be a $7500 interest free loan (for me) as we purchased the home 8/1/08. It seems to suggest that the new bill will give a $8000 tax credit (NOT needing to be repaid) to people who buy a home in 09.

I already am claiming the mortgage interest on my current home. I have recently bought another house as an investment and would like my daughter to occupy it and pay the mortgage, insurance and property taxes.

How could I give her the right to claim the mortgage interest without transfering title to her?
